HomeMy WebLinkAboutORDINANCES-1962-010-O-62• • 399 10-0-62 AN ORDINANCE Amending the Evanston Zoning Ordinance, Adopted November 21, 1960, as amended. WHEREAS, on April 12, 1961, the Honorable Daniel A. Roberts, one of the Judges of the Circuit Court of Cook County, Illinois, entered a decree in Case No. 60-C-1603, entitled LaSalle National Bank, Trustee under Trust No. 21956 vs. City of Evanston, holding that the Zoning Ordinance of the City of Evanston was arbitrary, unreasonable, confis- catory, and void as it applied to the following described premises: Lot 2 in Paul Daniel's Subdivision of the South 3 1/8 acres of the North 12 1/2 acres of the North 1/2 of the Southwest Quarter of the Northeast Quarter of Section 25, Town- ship 41 North, Range 13, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, the above described premises are located east of Dodge Avenue immediately south of and adjacent to the Chicago, North Shore & Milwaukee Railroad right-of-way abutting Lot 1 in said subdivision, said Lot 1 having a frontage of approximately 106.55 feet on Dodge Avenue, and both Lots 1 and 2 extending approximately 629.17 feet east- ward from Dodge Avenue, being a continuous tract of vacant 0 400 land consisting of 60.909 square feet. Lot 2 adjoins the east line of Lot 1 and extends 504.17 feet with a depth of 94.55 feet; and r WHEREAS, the decree of the Circuit Court of Cook 4 County entered on April 13, 1961, was affirmed by the Supreme Court of the State of Illinois, and the opinion of said Court entered of record January 23, 1962; and WHEREAS, in the opinion of the City Council, in endeavoring to comply with the decree of the Circuit Court, the highest and best use of Lot 2 would be to provide greater • land use intensity to Lot 2 than a single family use. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS- SECTION 1.- That the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, as amended, be further amended as follows: That the following described property now zoned R2 be and the same is hereby zoned R3 Two -Family Residence District. The regulations and restrictions applicable to R3 Two -Family Residence District and the penalties provided for in said Zoning Ordinance adopted November 21, 1960, as amended, shall hereafter apply to the following property -2- • • 401 Lot 2 in Paul Daniel's Subdivision of the South 3 1/8 acres of the North 1.2 1/2 acres of the North 1/2 of the Southwest Quarter of the Northeast Quarter of Section 25, Township 41 North, Range 13, East p, of the Third Principal Meridian, in Cook County, Illinois. SECTION 2; The Official District Map of the Zoning Ordinance of the City of Evanston, as amended, shall be further amended in accorda;ice with -che provisions of this ordinance. SECTION 3: All ordinances or parts_ of ordinances in conflict • herewith are hereby repealed. SECTION 4? This ordinance shall be in full force and effect after its passage, approval, and publication, according to law.
