HomeMy WebLinkAboutORDINANCES-1962-017-O-62 (2)17-0-62 AN ORDINANCE Amending the Evanston Zoning Ordinance Adopted November 21, 1960, as amended. (Blietz, Crawford Ave. Property) WHEREAS, Irvin A. Blietz did file a petition with the Zoning Amendment Committee to rezone 10 vacant lots with 261 feet of frontage on the west side of Crawford Avenue, located from approximately 140 to 400 feet south of Central Street, from R4 General Residence Use District to B1 Business Use District; and WHEREAS, the Zoning Amendment Committee under date of • May 26, 1961 recommended upon a public hearing that the zon- ing of said area be changed from an R4 General Residence Use District to a'B1 Business Use District, which recom- mendation the City Council is not willing to confirm by ordinance; and WHEREAS, under date of March 30, 1962, the City of Evanston did enter into an agreement with Irvin A. Blietz wherein Blietz agreed and did convey title to the aforesaid parcel of land'to LaSalle National Bank, as Trustee under Trust No. 28959, and did grant to Blietz a period of three years from'the date of the,adoption of this ordinance during which period Blietz has agreed to negotiate with substantial persons or companies for long term leases and to improve said • property with a modern office building to be constructed substantially as per artist's drawing thereof and plans of elevations and interior layout, all of which appears from exhibits attached to said agreement and made a part thereof. Under the terms of said agreement if Blietz fails to nego- tiate for suitable tenants and to commence the construction of a modern office building substantially of the type as shown and described in the exhibits attached to said agree- ment within a period of three years from the date of the adoption of this ordinance, or in the event he is unwilling within said period of time to proceed with the development of the property as described in said contract, then the City • may rezone said property to its former status of an R4 General Residence Use District. • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS- SECTION 1; That the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, as amended, be further amended as follows: 1. The following property now classified as R4 General Residence Use District on the Offi- cial District Map of the Evanston Zoning Ordinance is hereby zoned B1 Business Use District. The regulations and restrictions applicable to B1 Business Use District and the penalties provided for in said Zoning Ordinance, adopted November 21, 1960, as amended, for a violation of any such regu- lations and restrictions shall hereafter apply to the following property; -2- • Lots 25 to 34, inclusive, in Resubdivision of Lots 25 to 34, inclusive, (except the East 10 feet thereof dedicated for North Crawford Avenue) together with Lot 35 and vacated alley lying between said Lots 25 to 34 and Lot 35 in Highlands Terminal First Addition, being a Subdivision of Lot 1 (except the East 25 feet thereof) in Ketter and Evert's Subdivision of part of the North East fractional quarter of frac- tional Section 10, Township 41 North, Range 13 East of the Third Principal Meridian, together with Lot 33 in High- lands Terminal, being a Subdivision of the North East fractional quarter of fractional Section 10, Township 41 North, Range 13 East of the Third Principal Meridian, in Cook County, Illinois. 2. The foregoing change in the zoning of said property is subject to the terms and conditions of a certain agreement dated March 30, 1962, between Irvin A. Blietz, LaSalle National Bank, as Trustee under Trust No. 28959, and the City of Evanston, a munici- pal corporation. SECTION 2. The Official District Map of the Zoning Ordinance of the City of Evanston, as amended, shall be further amended in accordance with the provisions of this ordinance. SECTION 3: All ordinances or parts of ordinances in con - I flirt herewith are hereby repealed. • -3- • SECTION 4e This ordinance shall be in full force and effect after its passage, approval, and publication, according to law.
