AN ORDINANCE
Amending Chapter 21 of the Evan-
ston City Code by adding thereto
Sections 21-19.1 to 21-19.7 to
Prohibit the Throwing or Deposit-
ing of Litter in Public Places in
the City of Evanston.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTIN, COOK COUNTY,
ILLINOIS:

SECTION 1: Chapter 21 of the Municipal Code of the City
of Evanston is hereby amended by adding thereto
Sections 21-19.1 to 21-19.7, which sections shall read as follows:
"Section 21-19.1: It shall be unlawful for any person, firm
or corporation to throw or deposit litter in or upon any
street, alley, sidewalk or other public place within the city,
except in public receptacles, in authorized private recep-
tacles or city dumps.
"Section 21-19.2: No person, firm or corporation shall sweep
into or deposit in any gutter, street, alley or other public
places in the city, the accumulation of litter from any build-
ing or lot, or from any public or private sidewalk and drive-
way. Persons owning or occupying property shall keep the
sidewalk and parkway in front of their premises free from
litter.
"Section 21-19.3: No person while a driver or passenger in
a vehicle shall throw or deposit litter upon any street,
' alley, or other public place within the city or upon private
property.
"Section 21-19.4: No person, firm or corporation shall drive
or cause to be driven any truck or other vehicle within the
city upon any public street or way unless such vehicle is so
constructed, loaded or covered as to prevent any load, contents
or litter from being blown or deposited upon any street, alley
or other public place. Nor, except as provided in Section 42-
131 of this code, shall any person drive or move any vehicle
or truck within the city, the wheels or tires of which carry
onto or deposit in any street, alley, or other public place,
mud, dirt, sticky substances, litter, or foreign matter of any
• kind.

"Section 21-19.5: No person shall throw or deposit litter on
any private property within the city whether owned by such
person or not, except that the owner or person in control of
private property may maintain private receptacles for collec-
tion in such a manner that litter may be prevented from being
carried or deposited by the elements upon any street, alley,
sidewalk or other public place or upon any private property.
"Section 21-19.6: The owner or person in control of any
private property shall at all times maintain the premises
free of litter. Provided, however, that this section shall
not prohibit the storage of litter in private receptacles
for collection, which receptacles shall be maintained in a
clean and sanitary condition and shall be so constructed as
to prevent the litter deposited therein from being carried
or deposited by the elements upon any street, alley, side-
walk or other public place or upon any private property.
"Section 21-19.7: For the purpose of this ordinance "litter"
shall include, but is not limited to, putrescible animal and
vegetable waste resulting from the handling, preparation,
cooking and consumption of food; other putrescible waste,
including dead animals, yard clippings and leaves; nonput-
rescible solid waste (except body waste), including rubbish,
ashes, street cleanings, abandoned automobiles, solid market
and industrial wastes, paper, wrappings, cigarettes, card-
board, tin cans, glass, bedding, crockery, and similar
• materials; and all other waste materials which if thrown or
deposited as herein prohibited deem to create a danger to
public health, safety and welfare."
SECTION 2: If any section, paragraph, sentence, clause,
phrase, or portion of this ordinance is for
any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining portions hereof.
SECTION 3: Any person, firm or corporation violating the
terms of this ordinance shall be fined not
more than Two Hundred Dollars ($200) for each such offense. Each day that any
violation to this ordinance shall continue shall constitute a separate offense.

SECTION 4: This ordinance shall be in full force and
effect from and after its passage, approval
and publication as required by law.
