HomeMy WebLinkAboutORDINANCES-1964-044-O-64144 Revised 4-28-64 5- 4-64 44-0-64 AN ORDINANCE Amending Section 23-3 of the Code of the City of Evanston, 1957, as amended BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1. That Section 23-3 of the Code of the City of Evanston, 1957, be amended to read as follows-, "Section 23-3. Inspection and Right of Entry. The director of housing and his authorized representatives are hereby authorized to make • inspections of all buildings, structures, and premises located within the city to determine their compliance with the provisions of this chapter. For the purpose of making such in- spection, the director of housing and his authorized representatives are hereby author- ized to enter, examine and survey all buildings, structures, and premises within the city. Such inspections shall be made between the hours of 8:00 A.M. and 8:00 P.M. on any days except Sunday, subject to the following standards and conditions: (a) An entry for the purpose of making any such inspection may take place only if a complaint respecting said premises has been received by the director of housing and such complaint, in the opinion of said director, provides reasonable grounds for belief that a viola- tion exists, or such inspection is under- taken as part of a regular inspection program whereby certain areas of the city are being inspected in their entirety by direction of the director of housing or the City Manager; (b) Such inspections shall be made by the director of housing or the City Manager or by any • duly authorized representative upon the direction of either of said officers; 145 (c) Any person making such inspection shall furnish to the owner or occupant of the structure sought to be inspected, suffi- cient identification and information to enable the owner or occupant to determine that he is a representative of the City of Evanston, and to determine the purpose of said inspection. If any inspection is made or sought to be made in compliance with the standards and conditions herein - above provided, an order of court, search warrant, or other legal process shall not be necessary to make such entry. The owner or occupant of every dwelling unit, rooming unit, or premises, or the person in charge thereof, shall give the director of housing or the City Manager, and duly author- ized representatives of either officer free access to such dwelling, rooming unit, or premises for the purpose of inspection, examination and survey, if such inspection, examination and survey is undertaken pursuant to the provisions of this section. Nothing contained in this section shall authorize • entry by force into any residence, building, structure, or premise without an order of court, search warrant, or other legal process, if the owner shall refuse to grant entry in violation of the terms of this section." SECTION 20 All ordinances or parts of ordinances in conflict herewith are hereby repealed.
