• AN ORDINANCE
Amending Chapters 5 and 28 of the
Code of the City of Evanston by
adding thereto Section 5-16.1,
Regulating Dogs in Public Places
in the City of Evanston, and
Amending Section 28-1.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS.
SECTION to That Chapter 5 of the Code
of the City of Evanston
is hereby amended by adding thereto Section 5-16.1, which
section shall read as follows°
"If any dog shall commit a nuisance on any street,
sidewalk, alley or public place in the city, or
upon any private property, other than that of the
dog owner, the owner or agent of the owner having
control of said dog shall immediately abate said
• nuisance by cleaning the premises and removing
the subject matter of the nuisance."
SECTION 2< That Section 28-1 of the
Code of the City of Evan -
stop is hereby amended by adding thereto the following paragraph!
"The provisions of this section shall not be construed
to define a violation of this Code when the owner whose
dog has committed a nuisance on any street, sidewalk,
alley, public place, or private property, other than
that of the owner, shall immediately abate the nuisance
in the manner provided in Section 5-16.1 of this Code.
Nor shall the owner of any dog be guilty of a viola-
tion of this section when the nuisance is committed by
the dog on the owner's property, if the offensive sub-
stance is removed within twenty-four hours."

SECTION 3: Any person who violates
• the terms of this ordi-
nance by failing to remove said nuisance shall be guilty of a
misdemeanor, punishable by a fine of not less than eight dollars
($8.00) for the first offense, not less than fifteen dollars
($15.00) for the second or any subsequent offenses, nor more
than two hundred dollars ($200.00) for each such offense. This
maximum fine of two hundred dollars ($200.00) is established
notwithstanding the maximum fine provided in Section 1-4 of the
Code of the City of Evanston.
SECTION 4: This ordinance shall be in
full force and effect from
and after its passage, approval, and publication in the manner
provided by law.
