HomeMy WebLinkAboutORDINANCES-1964-049-O-641 -f- 405 • Revised Draft 2/8/65 AN ORDINANCE Amending Sections axR, 5-13, and 5-14, =tom, and Establish- ing Section 5-25, of the Code of the City of Evanston, 1957, "Animals and Fowls" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 5-13 of the Code of the City of Evanston, 1957, as amended, be amended to read as follows: "Any dog for which the license fee for the current year has been paid, which may during such year be impounded or taken up for being at large, may be redeemed by the owner of such dog upon payment of the cost of keeping such dog while impounded. If any such dog shall not have been redeemed by the owner thereof within fourteen days after being impounded, the animal control warden may dispose of such dog." SECTION 2: That Section 5-14 of the lkl Code of the City of Evanston,x 1957, as amended, be amended to read as follows: "Any unlicensed dog which shall have been im- pounded may be redeemed by the owner of such dog upon payment of the cost of keeping such dog while impounded, plus the annual license fee provided in Section 5-10 of this code. If any such dog shall not have been redeemed by the owner thereof within seven days after being impounded, the animal control warden may dispose of such dog." Y 406 SECTION 3: That Section 5-25, to read • • as follows, be added to the Code of the City of Evanston, 1957, as amended: "Any person who shall violate any provision of Section 5-7 or Section 5-16 (a) to (d), inclusive, of the Code of the City of Evanston, 1957, shall be guilty of a misdemeanor, punishable by a fine as follows: (a) For violations of Section 5-7 pertaining to dog licensing requirements, a fine of not less than eight dollars ($8.00) for the first offense within any license year. If any person shall have failed to secure a dog license within ten (10) days after receiving a summons for failure to have a current license, the fine shall be not less than fifteen dollars ($15.00) for this second offense or any subsequent offense in any license year, provided that no fine shall exceed two hundred dollars ($200.00). Said fine shall be payable, notwithstanding action by the animal control warden to disc pose of said dog as provided in Section 5-14, or notwithstanding any action by the owner to dispose of said dog or to give up his ownership rights in said dog. (b) For violations of Section 5-16 pertaining to "Dogs on Leashes", a fine of not less than three dollars ($3.00) for the first offense in any calendar year and not less than eight dollars ($8.00) for the second or any subsequent offense in any calendar year, provided that no fine shall exceed two hundred dollars ($200.00). "The maximum fines of two hundred dollars ($200.00) are established notwithstanding the maximum fine provided for in Section 1-4 of the Code of the City of Evanston, 1957.11 SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.
