HomeMy WebLinkAboutORDINANCES-1964-073-O-64• .L a D 73-0-64 AN ORDINANCE Repealing Ordinance 81-0-63 WHEREAS, the City Council of the City of Evanston did on January 6, 1964, adopt a certain ordinance, numbered 81-0-63, granting a special use permit to Frank Clesen to construct a greenhouse at 315 Dewey Avenue, Evanston, Illinois, subject to certain conditions; and WHEREAS, said ordinance, with the specific conditions, had been recommended by the Zoning Board of Appeals after public hearing in the manner provided by laws and WHEREAS, it was the intention of the City Council to • grant said special use permit only upon the conditions enumer- ated in said ordinance; and WHEREAS, the applicant, Frank Clesen, has now filed a certain cause in the Circuit Court of Cook County entitled, "Frank Clesen vs. City of Evanston, a Municipal Corporation, and Buell Dutton", which cause is docketed as number 64 L 2496, wherein the plaintiff seeks to enjoy the benefits of said special use permit without complying with the conditions of said ordinance; and WHEREAS, the City Council of the City of Evanston has determined that the public interest requires that a special use for greenhouse purposes be permitted only subject to the conditions set forth in said ordinance and not without said conditions as sought by the plaintiff in said lawsuit: • • 0 A, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Ordinance 81-0-63, an ordinance granting a special use permit to Frank Clesen, adopted January 6, 1964, be and it is hereby repealed. SECTION 2: That this ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
