WHEREAS, the Zoning Board of Appeals has recommended that the application of Morris Stern and Margaret Stern for a Special Use Permit to construct a nursing home on the premises at 120 Dodge Avenue, be granted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOISi SECTION 1: The recommendation of the Zoning Board of Appeals is hereby confirmed and the Director of Building and Zoning is ordered and directed to grant a permit to Morris Stern and Margaret Stern to construct a nursing home on the property commonly described as 120 Dodge Avenue, Evanston, Illinois, and being legally described as - Lots 1. 2, 3, 4 and 5 in Block 4 in W. itayden Bell's Howard -Dodge Subdivision of the South half of the Southeast quarter of the Northwest quarter (except the South 2.572 chains thereof) of Section 25, Township 41 North, Range 13, East of the Third Principal Meridian in Cook County, Illinois, except the East 7 feet of said Lots taken for widening of Dodge Avenue$ subject to the condition that the property owners enter into a restrictive covenant running with the land infavor of the City, and providing as Follows: , 1. The property shall never be used to accommodate more than fifty-six beds in the nursing home. 2. All portions of the land not occupied by a building constructed pursuant to Ordinance No. 14-0-65, adopted by the City Council -of the City of Evanston, shall remain open and un- obstructed to the sky and no expansion, addition or enlargement of said building shall be undertaken. • 9 I r . 442 0 3. The several lots comprising the subject property shall be consolidated and recorded in the Office of the Recorder of Deeds of Cook County* Illinois, as one parcel of land. 4.. This covenant is made In favor of the City of Evanston, a municipal corporation, and may be enforced by it. 5. On 'or before March 1, 1965, Covenantors, at their expense, shall record this covenant in the Office of the Recorder of Deeds of Cook County or file the same with the Registrar of Titles of Cook County, whichever is appropriate, and shall pro- vide the City Clerk of the City of Evanston with a certified copy of said recorded or registered covenant. If said property is registered pursuant to An Act Concerning Land Titles, approved May 10 18970 as amended, then the Covenantors shall also submit to the Corporation Counsel of the City of Evanston, its Owners' Duplicate Certificate of Title with this covenant duly memorialized thereon.
