BE IT ORDAINED By THE CITY COO IL Or THE CITY OF EVANSTON* COOK COUNTY, ILLINOIS: SECTION It That a variation be granted to the Cos Corporation from the terms of the Evanston Zoning Ordinance„ adopted November 210 19640 to perms;: the installation of an access driveway on the property located at 2448 to 2522 Ridge Avenue and legally de- scribed as fol.lowsa Lot "A"s Lots 33 to 2�, and parcel, "A", inclusive, all In Frank F.•Holmes; Subdivision of that part of the Northwest Fractional quarter of Fractional Section 7, Township 41 North, Range 14, East of the Third Principal. Meridian„ Cook County, Illinois,, The center3 line of said access driveway shall be the extension of a line bisecting the Cos Building located on said property and running generally in an easterly -westerly direction fi between the face of said building and the west ling of Ridge Avenue. The access driveway shall consist of an entrance roadway and an exit roadway, neither to exceed 12 feet in width, and a center strip, the width of which may be determined by the Cos Corporation. SECTION 2: The variation herein granted shall be conditioned upon the_ followi.ngi A. The access driveway, within substantially all of the 38 foot setback area, shall be level with the adJacent areas to the north and south and shall be at grade with the existing sidewalk on Ridge Avenue -along the north side of the driveway. B. The median strip of the access driveway shall. be extended easterly to the west curb line of Ridge ,Avenue and shall be constructed in such a manner Y E • • as to constitute a pedestrian island for the refuge or persons using the sidewalk along Ridge Avenue. C. A plan for the access driveway and the pedes- trian island, including lighting, conforming substantially to the requirements of this ordinance shall be submitted to and approved by the Public Works Department and the Land Use Committee of the City Council prior to commencement of construction. D. Cos shall grant to the City of Evanston for the use of the public, an easement in said access driveway and shall further execute a hold harm- less agreement in a form satisfactory to the Corporation Counsel under which the City of Evanston shall be indemnified for all claims. damages and judgments of any kind anl'nature whatsoever arising out of the use of said easement by the public and shall further be indemnified for all costs, attorney's fees and other expenses arising out of any actions brought against the City arising out of the use of said easement. Cos shall purchase an insurance policy specifically covering the liability described in this paragraph, and the insurance shall be in such form and in such companies as ,is acceptable to the City of Evanston. SECTION 3; This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
