AN ORDINANCE
Amending Sections 23-1, 23-2, 23-6,
23-7, and 23-8 of the Housing Code,
Being Chapter 23 of the Code of the
City of Evanston, 1957.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 23-1 of the
Housing Code of the City of
Evanston, 1957, defining a "rooming unit," be amended to read
as follows:
"Rooming Unit shall mean a room or group of rooms
forming a single habitable unit which is not
physically a part of a dwelling unit, or which
though physically a part of a dwelling unit is
used or intended for use by a person or persons
other than members of the family occupying said
dwelling unit, and which is used or intended to
be used as a sleeping and living quarters, but
without facilities for cooking, eating, food storage
or food preparation. No rooming unit shall contain
facilities such as stoves, hot plates, other appli-
ances for cooking or heating foods or beverages,
refrigerators or kitchen sinks whether or not such
appliances are currently connected to power sources
or water and drainage facilities. Every rooming
unit located in a dwelling unit shall be under the
direct control of the principal occupants of said
dwelling unit, shall be accessible at all times to
said occupants and, if rented, shall be rented by
said occupants rather than by an agent or a third
party. Where a rooming unit is located within a
dwelling unit no occupant of said rooming unit shall
use any area for cooking, eating, food storage or
food preparation except for the principal kitchen of
the dwelling unit within which said lodging room is
located."

SECTION 20 That Section 23-2 of the
Housing Code of the City of
Evanston, 1957, be amended so as to read as follows:
"The director of housing may specify and provide
such written rules and regulations as may be
necessary for the proper enforcement of the pro-
visions of this chapter; provided, that such rules
and regulations shall not be in conflict with the
provisions of this chapter. After their approval
by the Corporation Counsel, the director of housing
shall file a copy of all rules and regulations with
the City Clerk. Such rules and regulations shall
have the same force and effect as the provisions
of this chapter, and the penalty for the violation
thereof shall be the same as the penalty for the
violation of the provisions of this Code."
SECTION 3: That Section 23-6 of the
Housing Code of the City of
• Evanston, 1957, be amended by adding thereto Subparagraph (j)
which reads as follows:
11(j) Not withstanding any provision to the contrary
in above paragraphs (a) or (b), no window area shall
be required in any kitchen which does not contain an
eating area and which was constructed under an
applicable provision of the Building Code of the
City of Evanston, which code did not require a window
area."
SECTION 4: That Section 23-7, Subpara-
graph (b) of the Housing Code
of the City of Evanston, 1957, be amended so as to read as
follows:
11(b) Every window, door, and basement hatchway
shall be reasonably weathertight, watertight,
and rodent -proof and shall be kept in good repair."

SECTION 5: That Section 23-8, Subpara-
graph (f) of the Housing
Code of the City of Evanston, 1957, be amended so as to read
as follows°
"(f) In every existing dwelling the finished floor
to finished ceiling height of every habitable room
must be at least six feet, eight inches. No ducts,
pipe, electrical ceiling fixtures shall obstruct the
passage in or out of any room or the normal passage
about any room. All newly constructed habitable rooms
must have a floor to ceiling height as required in
Section 501 of the Basic Building Code as adopted by
the City of Evanston."
SECTION 6: That all ordinances or parts
of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
SECTION 7: That this ordinance shall be
in full force and effect from
and after its passage, approval and publication in the manner
provided by law.
