WHEREAS, the City of Evanston has been authorized by law to acquire sites, buildings and facilities for park purposes; and f WHEREAS, the City Council has determined that it is nec- essary and convenient to acquire the real estate, hereinafter described, for park purposes: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: It is hereby determined that it is necessary, convenient and desirable for the City of Evanston to acquire for park purposes in the City of Evanston the property hereinafter • described. SECTION 2: It is hereby determined that it is necessary, convenient and desirable for the City of Evanston to acquire title to and possession of the following described real estate in the City of Evanston, County of Cook and State of Illinois, to -wit: Those parts of Lots 1, 2, 3, and 4 in Block 3 in Grant and Jackson's Addition to Evanston, as per plat recorded May 6, 1874 in book 7 of plats, on page 70, Lots 3 and 4 in the Resubdivision of Lots 1 and 2 in Block 12 and all of Lot 3 and those parts of Lots 4, 5 and 6 in Block 12 of Evanston Center Addition, as per plat recorded September 12, 1874 in book 8 of plats, on page 99, all of the above land being in Section 13, Township 41 North, Range 13 East of the Third Principal Meridian, - which lies Northwesterly of a line drawn parallel with and distant 43.50 feet Northwesterly (measured at right angles) from the center line of the most Northwesterly main track of the Chicago and Northwestern Railway Co. said main track is now located and established over and across said Blocks 3 and 12 in Cook County, Illinois, r n �J 380 which real property is necessary, convenient and desirable for park purposes. SECTION 3: That the Corporation Counsel of the City of Evanston, be and he is hereby authorized, empowered and directed to negotiate for and on behalf of the City of Evanston with the owner or owners of the real property herein described for the purchase thereof by the City of Evanston, and in the event that the Corporation Counsel is unable to agree with the owner of said real property upon the compensation to be paid therefor, the Corporation Counsel of the City of Evanston is authorized, empowered and directed to cause condemnation proceedings to be instituted for the purpose of acquiring for the City of Evanston • title to and possession of the real property specifically described in this ordinance, in accordance with the eminent domain laws of the State of Illinois. • SECTION 4: Ordinance 42-0-66 adopted by the City Council on April 4, 1966 is hereby repealed.
