HomeMy WebLinkAboutORDINANCES-1966-060-O-66• 4` Y AN ORDINANCE Amending Sections III, IV, X and XII of the Evanston Zoning Ordi- nance, Adopted November 21, 1960. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the following paragraphs, subsections, and sections of the Evanston Zoning Ordinance, adopted November 21, 1960, as amended, be further amended so that the same shall hereafter be and read as follows: 1. That Section III be amended by adding the following definitions in alphabetical sequence: • "BUILDING, NON -CONFORMING. A lawfully established building which does not presently conform to all the applicable requirements of this ordinance governing height, bulk, location on a lot, off- street parking and off-street loading. 0 STRUCTURE, NON -CONFORMING. A lawfully established structure which does not presently conform to all the applicable requirements of this ordinance governing height, bulk, location on a lot, off-street parking and off-street loading. RETIREMENT HOME (Home for the Aged). An establishment providing living accommodations and medical services principally to persons 65 years of age or over. Accom- modations provided may consist of dwelling units of any type, rooming units or nursing home beds." 2. That Section III be amended by revising the following definitions, which shall hereafter read as follows: "NURSING HOME (CONVALESCENT HOME, SHELTERED CARE -HOME, INFIRMARY). An establishment for the care of children or the aged or infirm. Such a home shall not contain equipment for or provide care in maternity cases or for psychotics or other unruly mentally deranged persons nor for surgical or medical cases commonly treated in hospitals. • • USE, NON -CONFORMING. A lawfully established use of land, buildings, structures or premises which is not a presently listed permitted or special use under this ordinance and which is not a use granted by variation subsequent to the adoption of the 1960 Comprehensive Amendment to the Zoning Ordinance." 3. That Section III be amended by adding the following sentence to the definition of "BUILDING, RESIDENTIAL": "Buildings used in whole or in part as hotels, rooming houses, boarding houses, nursing homes, retirement homes, dormitories, fraternities, and sororities and other institutional housing shall be considered as non-residential buildings." 4. That Section IV, Subsection F, Control Over Bulk, be amended by adding the following paragraph to this subjection: "Nothing contained in this section, the district regulations or the section on non -conforming buildings, structures and uses of this ordinance, shall be con- strued to prevent any existing building or structure which is non -conforming only with respect to required yards from being enlarged, reconstructed, structurally altered, or relocated in a manner which will not further conflict with .the provisions of this ordinance, or increase the non -conforming aspects of said building or structure. Such enlargement, reconstruction, al- teration, or relocation shall not be permitted for buildings occupied in whole or in part by a non- conforming use, nor for the purpose of adding a dwell- ing unit, converting a building to residential pur- poses or to increase the density of residential use unless said building is brought into conformity with all applicable requirements of this ordinance." 5. That Section IV, Subsection I. Special Uses, be amended by adding the following sentence to this subsection: "Any change in use to a use other than a permitted use or expansion of an existing Special Use shall be authorized only in accordance with the same procedures as those required by this ordinance for a new Special Use." 6, That Section X, Subsection B, Off -Street Parking, • paragraph 10, subparagraphp,be amended by deleting the words "for the Aged or" from this paragraph. 7. That Section X, Subsection B, Off -Street Parking, paragraph 10, be amended by adding thereto new subparagraph aa, to read as follows: "aa. Retirement Home One parking space for each four employees, plus one parking space for each six (6) in- firmary or nursing home beds, plus one parking space for each four rooming units, plus 0.75 parking space for each attached or detached single-family dwelling, plus one parking space for each two dwelling units of all other types." 8. That Section X, Subsection B, existing paragraph 10(aa)be changed to paragraph 10(bb). 9. That.Section XII, Subsection B, Board of Appeals, paragraph 3, be amended by deleting the words "Director of Building" and substituting the words "an Enforcing Officer" in the first sentence of this paragraph. 10. That Section XII, Subsection B, paragraph 4, sub -paragraph a, be amended by deleting the words "Director of Building" and substituting the words "an Enforcing Officer". SECTION 2: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
