BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That,Chapter 8 of the Code of the City of Evanston, 1957, "Bicycles" be and the same is hereby amended to read as follows: "ARTICLE I. IN GENERAL. "Sec. 8 - 1. Applicability of traffic laws. Every person operating a bicycle on any street or thoroughfare in the city shall be subject to the pro- visions of Illinois Revised Statutes, Chapter 95!/2, paragraph 121, and to the provisions of Chapter 27 of this code, applicable to the drivers of vehicles, ex- cept as to those provisions which by their nature can have no application to bicycles. "Sec. 8 - 2. Obedience to official traffic devices and Or signs. It shall be unlawful for any person operating a bicycle to: a. fail to obey the instructions of an official traffic control signal; b. fail to obey a stop sign; c. fail to obey official signs applicable to drivers of vehicles, including "U" turns where posted. "Sec. 8 - 3. Manner of riding. Any person operating a bicycle shall not ride other than upon or astride the permanent and regular seat at- tached thereto, nor carry any other person upon such bicycle other than upon a firmly attached and regular seat thereon. 4 a3 .1 "Sec. 8 - 4. Regulations for operation of Bicycles generally. It shall be unlawful for any person to operate a bicycle in any of the following described manners or any of the following enumerated conditions: 1. At a speed greater than is reasonable or prudent under conditions then existing. 2. Upon any street or highway except as near to the right hand side of the same as practicable and with due care when passing any standing vehicle or any vehicle proceeding in the same direction. 3. To merge from any alley, public or private driveway or building upon any street, sidewalk or sidewalk area without yielding the right of way to all ve- hicles and pedestrians approaching upon such street, highway, sidewalk or sidewalk area. 4. By attaching the bicycle or the rider in any manner to any bus or vehicle upon the street or highway. 5. Riding in groups upon any street or highway, ex- cept in single file. 6. Carrying any package, bundle or article which pre- vents or interferes with the rider keeping both hands upon the handlebars. 7. Parking or leaving any bicycle upon any sidewalk • or against any building along any sidewalk in a manner which obstructs pedestrian use of the sidewalk. "Sec. 8 - 5. Riding Prohibited on certain streets and sidewalks It shall be unlawful for any person to operate a bicycle driven by muscular power, upon or along any of the following named streets and public thoroughfares within the City of Evanston, which have been determined by an official traffic survey as being heavily travelled by automobiles, or trucks, or both, and upon which the operation of bicycles, driven by muscular power, is hazardous and dangerous to the citizens of this com- munity as well as to the operators of said vehicles: - 2- 435 Burnham Place - Sheridan Road to Forest Avenue Central Street - Ridge Road to Sheridan Road Chicago Avenue - South City Limits to University Place Church Street - Dodge Avenue to Asbury Avenue Dempster Street - Forest Avenue to West City Limits Forest Avenue - Main Street to Davis Street Forest Place - Davis Street to Sheridan Road Green Bay Road - Lyons Street to North City Limits Main Street - Sheridan Road to West City Limits Ridge Avenue - South City Limits to North City Limits Sheridan Road - Forest Place to North City Limits Sheridan Road - South City Limits to Burnham Place No person shall ride a bicycle upon a sidewalk within any business district, as defined in the present or here- after adopted zoning ordinance. Whenever a person is riding a bicycle upon a sidewalk, such person shall yield the right of way to a pedestrian, and shall give audible signal before overtaking and passing a pedestrian. "Sec. 8 - 6. Equipment required. Every bicycle, when upon a street or highway, during the period from sunset to sunrise, shall be equipped with at least one lighted lamp exhibiting a white light, or light of yellow or amber tint, visible from a dis- tance of 500 feet to the front of the bicycle and with at least one lighted lamp exhibiting a red light visible from a distance of 500 feet to the rear. It shall be unlawful for any person to operate a bi- cycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least one hundred feet, and it shall be unlawful for any bicycle to be quipped with, nor shall any person riding a bicycle use any siren or whistle. It shall be unlawful for any person to operate a bi- cycle unless the same is equipped with handle grips and with a brake which shall enable the operator to make the braked wheel on such bicycle skid when operated on a dry, level and clean pavement. "Sec. 8 - 7. Duty of parents or guardians; applicability of provisions of chapter. No parent or guardian of any ward shall authorize or knowingly permit any child or ward to violate any of -3- 436 the provisions of this chapter. This chapter shall be applicable to all bicycles operated upon any street, alley, highway or sidewalk within the city. "ARTICLE II. LICENSES. "Sec. 8 - 8 Required. No person who resides within the city shall ride or propel a bicycle on any street or upon any public way within the city unless such bicycle has been licensed and a license is attached thereto as provided in this article. "Sec. 8 - 9. Fee; issuance; term. A license fee of one dollar shall be paid to the city before each license or renewal thereof is granted. The city collector, upon approval by the chief of police of the licensing of any bicycle, is authorized to issue a bicycle license, which shall be effective until the expiration of the period for which the same is issued. The license period shall commence on ,Tune 1 of each odd numbered year, and a license, when issued, shall expire on May thirty-first of the next odd numbered year fol- lowing the date of issue. "Sec. 8 - 10. When chief of police not to approve issuance of licenses. The chief of police shall not approve the issuance • of a license for any bicycle when he knows, or has any reasonable grounds to believe, that the applicant is not the owner of or entitled to the possession of such bicycle, or when the bicycle is not properly equipped in accordance with the provisions of this chapter and other ordinances of the city. "Sec. 8 - 11. City collector to keep record of licenses issued and fees collected. The city collector shall keep a record of the number of each bicycle license, the date issued, the name and address of the person to whom issued and the number on the frame of the bicycle for which issued, the permanent registration number of the bicycle, and a record of all bicycle license fees collected by him. MC is 4 :i; "Sec. 8 - 12. License - Issuance; contents. The city collector shall issue a bicycle license bearing the license number, assigned to the bicycle, the name EVANSTON and the period for which issued. The license as provided for in this section of the code shall be firmly attached to the frame of the bicycle for which issued. "Sec. 8 - 13. Same - Not to be removed from bicycle; exception. No person shall remove a license from a bicycle during the period for which issued except upon transfer of owner- ship or in the event the bicycle is dismantled and no longer operated upon any street in the city. "Sec. 8 - 14. Same - Duty of licensee to remove upon sale or disposal. Upon the sale or other disposal of a licensed bicycle, the licensee shall remove the license, and the new owner, if any, shall secure a license as required by this Article. "Sec. 8 - 15. Inspection of bicycles by chief of police prior to issuance of licenses. The chief of police shall cause the inspection of each bicycle before approving the licensing of the same and shall refuse to approve a license for any bicycle which he determines is in an unsafe mechanical condition. "Sec. 8 - 16. Duty of rental agencies. A rental agency shall not rent or offer any bicycle for rent unless the bicycle is licensed and a license is attached thereto as provided in this article, and such bicycle is equipped with the equipment required for operation by the provisions of this chapter and other ordinances of the city. "ARTICLE III. REGISTRATION. "Sec. 8 - 17. Registration,- Required. No person who resides within the city shall ride or propel a bicycle on any street or upon any public way -5- 43,3 within the city unless such bicycle has firmly affixed to the frame a permanent registration plate issued by the police department. "Sec. 8 - 18. Same - Issuance. The police department shall issue a permanent regis- tration plate upon receipt of proper application. The department will affix the registration plate to left side of the vertical section of the frame under the seat. No person shall remove the registration plate from the bicycle at any time. "Sec. 8 - 19. Same - Duty of registered owner upon sale or other disposal of bicycle. Upon the sale or other disposal of a registered bicycle, the registered owner, or the new owner, will notify the police department in writing upon a form provided for this purpose. "Sec. 8 - 20. Impounding unregistered bicycles. The chief of police shall cause the impounding of unregistered bicycles and shall retain possession of such bicycles until satisfactory proof of ownership is received. Upon receipt of this proof of ownership a permanent registration plate will be affixed to the bicycle. "Sec. 8 - 21. Responsibility of parent. If the person subject to the requirements of this Article III is a minor, the duties herein imposed shall be performed by his parent or guardian." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. �J C] 43. SECTION 3: Any person, firm or corporation violating the terms of this ordinance shall be fined not more than twenty-five dollars ($25) for each such offense. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner pro- vided by law.
