tions Of tho 4vanston Zoning Ordi-
nance to Permit the Expansion of
the Second Dawning Unit to Occupy
all of the First Floor
WHEREA # the Zoning Board of -Appeal of the City of
Evanston hard a public hearing on February 20,E 1968 on the appeal
by Wilfred and "Phyllis Hurothouso for a variation from the non-
conformihq use regulations of the zoning ordinance to permit the
expansion of the ceooad dwelling unit to occupy all of tho first
floor of the building at 2921 Simpson itreot, which is -located
in tho RI zaioglo- amily Residence District; and
HZRM09, the Zoning Board of Appoals has recommended
ndenial of said appeal; and
WH.:KaAz".# tho City Council has reviewed the evidence adduce
at :said hoar:ing and is of the opinion that sald variation should
be grantod; and
WMIR18 jo the City Council has deteimind that the granting
of the variation will not alter the essential charactr of tho
neighborhood in which the property is Located since the building
has been nonconforming for a great many years and has not to data
adversely affected the neighborhood; and
WEiRE3, the City Gounoi,l has determined that the plight
of the owners is due to unique circumstances sinco the building
has no front yard duo to subdivision zany years before the zoning
ordinance became effective# and the streot has becomo a mein
highway; and

WN8HEAS# the City Council has datermined that the property,
could not yield a reasonable return if used as a single-family
dwellings and that an unreasonable investment would be required
to convert the building to a single-family dwelling since thaw
is no inside stairway to the second floor and since there is now

separate heating plants and the second floor has seven roams anC
corbini.ng the first floor area would result in an unmarketable
single-family resi.demce; and
WHEREAS,r the zoning ordinance if applied to the sub j oct
property would create a hardship in that the building has been
used for a nonconforming commercial use which had been discon-
tinued to the benefit of the community and the restriction to a.
single-family use would result in a failure to utilize the sub-
ject property for its highest and beat use consistent with the
neighborhood.
NOW* THEREFORE, BE: 1T ORDAINED BY THE CITY COUNCIL OF

SECTION l i That a variation from the noncon-

Evanston ;honing Ordinance, edopted November 21, 1960# to far as
said regulation% pertain to the property located at.2921 Simpson
street in the City of Evanston and lagally described as -
The nest 70 feet of the South 0 meet of Block 2
of 1. J. Smith's Addition to EVSnstan, a Sub-
division of the :youth 457.5 feet of the East 43
rods of the West half of the Southeast quarter of
Section Ilt Township 41 North, Runge 1.3, East of
the Third principal Meridian in Cook County,
Illinois,
is hereby granted so as to permit the expansion of the second
dwelling unit to occupy all of the first floor.
SECTION 21 The Director of Building is hereby
ordered and directed to grant such
permits or certificates of occupancy as shall be required to
effectuate the reconniendati.ons of the City Council of the City
