Granting the Appeal of J. A. Rohbi,ns for
a Variation from tho Use and Lot Area
aegulations of the .Cvanston Zoning Ordinv
nance# Adopted November 21, 1560.
WHEREAS, the Zoning Board of Appeals of the City of
Evanston held a public hearing on May 3# 1966 on the appeal
by J. AR Robbins for a variation from the use and .lot area rogd-
lati.ons of the zoning ordinance to permit the retention of five
dwelling units in the building ,located at 1533 Grain Streets
which property is legally described as -
The West 25 feet of Late 4 and 5 (extept the North
44 feet of the Waet 25 feet of said Lot 4) in flock
3 in Nate and Adams Addition to Evanston# being a
Subdivision of the South 8.07 acres of Lot 4 in
Bensonts, Subdivision of the North part of the East
half of t.ho Northeast quarter of Section 24 and the
North 8.44 acres of Lot 4 of Assessors Division
of the Northeast quarter of Section 24p Township
41 North* Range 13# East of the Third principal
Meridian in C-o*k County# Illinois; and
WHEREASo a majority of the Zoning Board of Appeals present
at the public hearing recamanded that said appeal fro granted but
the concurring vote of four .members on said recommendation was
riot obtained; and
WHEREAS# the City Council of the City of Evanston: ties
reviewed the evidence adduced at said'hearing and is of the
opinion that said variation should be granted; and

purchased the property in reliance upon a nonconforming use
certificate issued by the City of Evanston which purportedly
confirmed the .legal use for five apartments on said premises;
and

• + WHEREAS, the purchase of said property in reliance upon
said certificate issued by the City of Evanston and the refusal
to permit the retention of said units under the circumstances
would constitute a hardship; and
WHEREAS, the City Council has determined that the reten-
tion of said five units will not be detrimental to the public
welfare or depreciate other property in the neighborhood,
inasmuch as across the street to the south is a beauty shop,
and across the street to the west are a bakery, a dry cleaning
and tailor's shop, a lamp shop, and an antique shop,, and,
therefore, the variation, If granted, will not change the
essential character of the neighborhood; and
WHEREAS, the plight of the owner is due to unique cir-
cumstances in that he purchased the property in reliance upon
• a certificate and information indicating the legality of five

units issued by the City of Evanston.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTONO COOK COUNTY, ILLINOIS:
SECTION 1: That a variation be granted from
the use -and lot area regulations
of the Evanston Zoning Ordinance, adopted November 21, 1960, so
far as said regulations pertain to the property in the City of
Evanston, located at 1.533'Crain Street, and legally described
as -

The Wes} 25 feet of Lots 4 and 5 ( except the North
44 foot of the West 25 feet of said Lot 4) In Block
3 in Nate arid. Adams Addition to Evanston, being a
Subdivision of the South 8.07 acres of Lot 4 In
Senson's Subdivision of the North part of the East
half of the Northeast quarter of-ection 24 and the
North 8,44 acres of Lot 4 of Ass+essors`s Division
Of the Nortbeast quarter of Secti'an 240 Township

is hereby granted, pextaitted and iaade to as to permit tho reten-
tion of five dwelllnV urtits, 01V in accordance with the recom-
thendati.ons of a majority of the Zoning Board of Appeals present
at the public hearing.
Si!GTI N 21 That the variation herein granted
is subjoct to the following con-
ditions s
(l) that the doors to the second floor units be
replaced with approved 1-3/4 inch solid dare
(2) that the variation be granted only for the
tee of the present ownership; anj
(3) that a covonant of agreement to the above
conditions shall be executed in recordablo
fora by the appellants.
ECTION 3 t The Oi.rector of Building is
ordered and directed to grant
such permits or certificates as shall be required to effectuate
the r+ecor andati.ons of the City Council and the variation grantee
thereunder.
IECTI N 4: This ordinance shall be in full
force and effect from and after
its passage and approval in the manner provided by law.
