HomeMy WebLinkAboutORDINANCES-1968-052-O-68448 Amended 4-29-68 " 5-13-68 52-0-68 AN ORDINANCE Granting the Appeal of Glenview State Bank, as Trustee under Trust No. 586, for a Variation from the Use Regula- tions of the Evanston Zoning Ordinance, Adopted November 21, 1960. WHEREAS, the Zoning Board of Appeals of the City of Evanston held a public hearing on March 19, 1968 on the appeal of the Glenview State Bank, as Trustee under Trust No. 586, for a variation from the use regulations of the zoning ordinance to permit the use of the first floor of the building located at 3142 Central Street, which building is located in an R4 General Residence District, as a public office with ten occupants until • the year 2000; and WHEREAS, the City Council has previously allowed the use by six occupants until December 2, 1980; and WHEREAS, the Zoning Board of Appeals has recommended denial of the appeal to extend the time and number of occupants; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing and is of the opinion that said varia- tion should ge granted; and WHEREAS, the City Council has determined that the grant- ing of the variation will not alter the essential character of the neighborhood in which the property is located since the 4.10 • building has been nonconforming for a great many years and has not to date adversely affected the neighborhood; and WHEREAS, the City Council has determined that the plight of the owner is due to the unique circumstances that the said building contains residences as well as commercial property but that the zoning ordinance of the City of Evanston contemplates the elimination of such commercial use in residential areas, that the said property contains off-street parking sufficient to meet the requirements of the zoning ordinance and can with con- venience be used as an office occupied by ten persons; and WHEREAS, the City Council has determined that the property could not yield a reasonable return if continued in its present form and structure as financing necessary for conversion cannot be obtained, nor can financing for a possible purchaser be ob- tained due to the present restriction; and WHEREAS, the zoning ordinance, if applied to the subject property, would create a hardship in that the building has been used for a nonconforming commercial use and the restriction of such use would result in a failure to utilize the subject prop- erty for its highest and best use consistent with the neighbor- hood: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a variation from the use regulations of the zoning ordi- nance, adopted November 21, 1960, so far as said regulations 0 - 2- • • n U pertain to the property located at 3142 Central Street in the City of Evanston, and legally described as - Lot 6 in Block 6 in Arthur T. ,McIntosh's Central - wood Addition to Evanston, being a Subdivision of part of the fractional Section 11, Township 41 North, Range 13, East of the Third Principal Meridian in Cook County, Illinois, is hereby granted so as to permit the changing from occupancy by six persons to use as a business office of the McGuffin Lumber, Inc., subject to the conditions that not more than ten persons shall occupy the said premises and that the said use shall be eliminated by December 2, 1980; provided, however, that should 4,10 said McGuffin Lumber, Inc. remove from said premises, the occupancy limitation shall revert to six. SECTION 2: That a covenant of agreement to the above conditions shall be executed in recordable form by the appellants and delivered to the Corporation Counsel. SECTION 3: The Director of Building is hereby ordered and directed to grant such permits or certificates of occupancy as shall be required to effectuate the recommendations of the City Council of the City of Evanston. SECTION 4: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
