HomeMy WebLinkAboutORDINANCES-1968-055-O-68Amended 9-9-68 3 • 55 -0-68 Revised 9-16-68' AN ORDINANCE Granting a Special Use Permit for Planned Development to Northwestern University WHEREAS, the Zoning Board of Appeals has considered and reported on the application of Northwestern University for a Special Use permit for planned development to allow construction of multiple family dwellings on the property located at 1901-1927 Maple Avenue, Evanston, Illinois; and WHEREAS, the proposed uses on the property are allowed Special Uses in the U4 University Housing District in which the property is located; and WHEREAS, the proposed planned development is compatible • with the established character of the neighborhood in which it is located and will not adversely affect other property in the area; and WHEREAS, the proposed development best serves the purpose of conserving property values and encourages building development to the best advantage of the City of Evanston; and WHEREAS, the Zoning Board of r";ppeals has specifically found that a structure of 132 feet instead of 130 feet will not make any difference in the appearance in the building or to other property in the area; and WHEREAS, the Zoning Board of Appeals has found that the elimination of a rear yard will not adversely affect the area due to the adjoining property behind the proposed structure being owned by the Chicago Transit Authority; that the 0 133 • yard at the southwest corner of the proposed structure, which will be 27 feet instead of the 30 feet required, is directly opposite commercial properties and will not have any adverse effect on these properties or any future development or redevelop- ment of the property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: A Special Use permit for a planned_ development is hereby granted to Northwestern University to allow construction of multiple family dwellings on the property legally described as - Lots 4, 5, 6, 7 and 8, except the North 47 feet of Lot 7 in Paul Pratt's Addition to the Village of Evanston, • Illinois, being a subdivision of the Southwest 8% acres of the South half of the Northeast quarter of the Northwest quarter of Section 18, Township 41 North, RGnge 14, East of the Third Principal Meridian in Cook County, Illinois, commonly known as 1901-1927 Maple Avenue, Evanston, Illinois. This Special Use permit for planned development shall be in compliance with all applicable ordinances of the City of Evans- ton, except as herein provided. This Special Use permit shall also be subject to the following conditions: 1. that evidence of ownership or control satisfactory to the Corporation Counsel be provided by North- western University; 2. that the development shall be constructed in substantial conformance with the plans submitted; 3. that the top of the highest habitable story shall be limited to 125.3 feet, and the top of the elevator penthouse shall be limited to 132 feet; • -2 134 • 4. that the 89 parking spaces to be provided north of Garnett Place shall be developed in full com- pliance with all applicable provisions of the Zoning Ordinance, and shall be so maintained until development of the University's second phase pro- gram; at such time, these required 89 parking spaces shall be provided elsewhere within 500 feet of the subject property; 5. that the open plaza area on the top of the easterly parking structure shall be maintained as open space for pedestrian and recreational use and never be used for parking of automobiles; 6. that the University shall landscape all open areas, and first secure approval of final plans for land- scaping and any signs from the City Council; 7. Garnett Place, east of Maple Avenue, shall be im- proved by the University with paving, curb and gutter, sidewalks, drainage, etc. meeting in full the specifications of the City of Evanston, within three years after completion of the first phase project, unless Northwestern University has ob- tained the vacation of this street by that time; • B. that the University shall install a new 12-inch water main on Maple Avenue from Emerson Street to Foster Street; and on Foster Street from Maple Avenue to Sherman Avenue; in addition, the existing fire hy- drants on Maple Avenue and Foster Street (except for the hydrant on the corner of Maple Avenue and Emerson Street) shall be replaced or connected to the new 12-inch water mains; 9. that the University shall provide uniform sidewalks on the south and west side of the property extend- ing from the curb line to approximately one foot from the property line, and a sidewalk shall be provided on the north side of the site connecting with the existing sidewalk under the CTA overpass at Garnett Place, and existing curb returns into the property shall be replaced with new uniform curbs; 10. a ramp access to the top of the easterly parking structure shall be provided, with both the ramp and the parking structure being so designed as to be able to support Fire Department equipment; and 11. that a certificate of occupancy for the proposed building in the U4 University Housing District not be granted until a parking plan to compel use of off-street parking by the car -owning residents of • the building, acceptable to the City Council, is h dopted by the University. -3- 135 The plans for said planned development are attached hereto and made part of this ordinance as Exhibit A. All construction shall substantially conform to said plans, provided, however, that all ordinances of the city other than the Zoning Ordinance shall apply, and in case of conflict between the plans and said ordinances, the provisions of the ordinances shall prevail, ex- cept as otherwise provided herein. SECTION 2: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
