AN ORDINANCE
Granting the Appeal of F�ri.,t "motional. Bank
and Trust Company of Evanston, as Trustee
under Trust No. R* 97B, for a Variation from
the Nonconforming Building Rejulations of
the Evanston Zoning Ordinance, Adopted
November 21, 1960#
MiER�.A.,4 the Zoning Board of Appeals of the City of
vanston hold a public hearing on July 16* 1968 on the appeal
of the First National Bank and Trust Company of Evanston# as
Trustee under Trust No, R-970* for a variation from the non-
conforming building regulations of the zoning ordinance to par-
ssit the construction of an additional dwelling unit attached
to the existing single-family dwelling located at 1732 Brown
Avenue; and
• G, the► Zoning Board of Appeals has failed to come
to any decision on the said appseatl; and
WHEREAS* the City -Council has reui$w*4 the evidence
rosent
s adduced at said hearing and two of the eimb*rs/were of tho
opinion that the appeal should be granted and two of the members
present were of the 6pinion that the appeal should be denied;
and
Mi EAa* the City} Council has det.*=Ined that the grantin j
of the variation will not alter the essential character of the
115 General Residence District in which the property is located;
and
WHEREAS, the City Council has determined that the granting
of the variation, subject to certain conditions hereinafter
set forth, will not be detrimental to the public welfare or
• injurious to or depreciate the value of other property in the
neighborhood and will in fact enhance the neighborhood by the
general repair and improvement of the existing building; and
WHEMA t the City Council has deterw4ned that the property
as presently constituted cannot yield a reasonable return unless
the variation is granted.

SECTION 1 a That aat variation from the nonconform-

Residence District* be granted in so far as said regulations
pertain to the property located at 1732 Brown Avenue, and

Lets 71 and 72 in dock 2 in J. S. avland's
Evanston Subdivision of the tiouth+east quarter
of the Northwest quarter of ,section lit, Town-
ship 41 North Range 13, East of the Third
Principal MoRdian in Cook County.. Illi.noi.s#
subject to the following conditions:
( 1) that the some exterior construction be used
for the present structure and the additions
and
(2) that the four -foot side yard be permitted and
that tho appellant be required to build the
addition asp to the four -foot side yard.
SECTION 2: The Ui.rector of Building is hereby
ordered and directed to grant such

effectuate the recommendations of the city Council, of the City
