tion from tho floor area ratio and rear yard regulations and for
a special Use permit to. allow the construction of a gymnasium
on the property located in the R3 No -Family Residence Districts
and

ER .A�_�I, tine city Council "has reviewed the evidence
adduced at said hearing and is of the opinion that said varia-
tion should be granted; and
WH REM4 the City Covncil has determined that. the granting
of the variation will not alter the essential character of the
neighborhood in which the property is located since the proposed
use will be compatible with existing Uses in the area and is a
spoci.al use as defined in the Zoning Ordinance of the City of
Livanston respecting the subject Pr pertY x and
WHERLA3, the City Council. has determined that the plight
of the church .is due to the unique circumstances in that another
area for the relocation of the existing church and its struc-
tures cannot be .located and the religious and educational functions
of the church would be ieopardized if the relief sought wts not
granted; end

WEREAS1, the particular hardship on the church is that
• it would bra prevented from usinV its property in a tanner to
benefit the area and would Zaurit undue hardship; and
WHEREAS, the City Coun;:1.1 has determined that the granting
of the variation will not be detrimental to the public welfare
or injurious to or depreciator the Value of other property or
improvements in the neighborhood in which the property is lo-
cated since the request concerns only a changot of 41inches In
relation to the side yard, an i ncreaae of 0.6 to 0.7a in floor
area ratios and

struction of a gymnasium on the property located at 1120 Wash-
ington Street, with a floor area ratio of 0.78 and a side yard of
141 7Y'* �on the south. The application for a ;3peci.al Use permit
to permit the expansion of an �Xisti.ng tpeci.al use is hereby
granted, all in accordance with the recos endatlons of the
Zoning Board of Appeals.
SECTION 2: 'The Ui,.rector of Building is orderer
and directed to grant a permit to
St. Nicholas Parisho Catholic Bishop of Chicago* all in accordenct
with the findings and recomondations of the Zoning Board of
Appeals.
SECTION 3 t This ordinance shall be in full
force and effect from and sifter
