AN OADINANCS
Granting the Appeal of carve A. Ferrill
for a Variation from the Air Conditioning
Regulations. cif the Evanston Zoning Ordi-
nance, adapted November 21w 1.960*
WHEREAS* the Zoning Beard of Appeals of the City of
Evanston held a public hearing on November lg* 1968 on the appeal_
by Harve A. Forri.11 for a variation from the air conditioning
regulations of the zoning ordinance to permit the retention of
an air conditioning unit approximately five Feet from the south
line of the property .located at 24,48 Central Park Avenue# which
proporty Is located in the R3 33ingle Familyr R0Si.dence Ustrict,
instead of the ton feet required; and
WHI_"REAS the Zoning Board of Appeals has rocommended denial M1
of the appeal to permit said retention; and
WHEREAS, the City Council has reviewed the evidence
• adduced .at said heaving and is of the opinion that saki variatiork
should be granted t and
wH, the City Council has determined that the grant-
i.ng of the variation will, not alter the essential character of
the neighborhood in which the property is located in that the
home was purchased by carve A. Farri.l.l with the air conditioning
unit in placer and
WHEREASt the City Council has determined that the plight
of the owner is due to the unique circumstance in that the air
conditioning unit was installed and in place at the time of the
acquisition of the property without the knowledge of the owner
that said air conditioning unit was in violation of laws and

• granting of the variation will not be detrimental to the pubiic
welfare or injurious to or deprt*i.ate the value of anther property
or Improvements in the neighborhood in which the property is
lo,catsd for the reason that there is a stookadt fence along
the south property line and the neighbor next decor cannot sage
the unit and there is landscaping around that units :and the
property avaiers at 2444 Central park Avenue have stated that
they have no objections to the air conditioning unit at its
present location; and
WHEREAS, the City Council, has determined that proposed
variation will not impair an adequate supply of light and air to,
adjacent property, or substantially increase the danger of fire
or otherwise endanger the public safety, or appreciably diminish
or impair property values within the neighborhood

regulations pertain to the property located at $ Central park
Avenuo in the City of Evanston, and legally destribaed as
Lots 2 and 3 in McInteash's Centralwood Addition
to EVanstono being a subdivision of part of
fr8cti.onal Section 11, Township 41 North# flange
13, east of the Third principal Meridian in
Cook County, Illinois,
is hereby granted so ea to permit the retention of an air condi-
tioning unit approximately five feet from the south line of the
property located at 2448 Central Pars Avaenue# which property is
located in the R1 Single Family Residence District, instead of
