AN ORDINANCE
Vacating that Portion of Garnett Place
Lying Between Maple Avenue and the CTA
Right -of -Way.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CwTY OF
EVANSTON, COOK COUNTY, ILLINOI,S:
SECTION l: That that portion of Garnett Place
lying between Maple Avenue and the
CTA right-of-way, and legally described as -
That portion of Garnett Place Lying south of and
adjoining Lot 5 in Paul Pratt's Addition to Evanston,
a subdivision of the West W6 acres of the South half
of the Northeast quarter of the Northwest quarter of
Section lei, Township 41 North, Range 14, East of the
Third Principal Meridian in the City of Evanston,
Cook County, Illinois,
as cross -hatched and indicated by the words, "HEREBY VACATED"
on the plat hereto attached, which plat for greater certainty
is hereby made a part of this ordinance, be and the same is
hereby vacated and closed, inasmuch as the same is no longer
required for public use and the public will be•subserved by such
vacation, provided,, however, that said vacation shall be subject
to any public utilities presently installed or located therein,
together with right of egress and ingress for maintenance of the
same, and provided that the following conditions shall be complied
with and met:
1. That Northwestern University shall pay for necessary
relocation of the street lighting installations in the
portion of Garnett Place to be vacated and shall pay the
cost of operation of any street lighting units .retained
in said vacated area. As an alternative to relocation,
if Northwestern University elects to leave the street
lighting installations in their present location, it
shall grant the City an appropriate easement for
maintenance of these street lighting installations.
2. That Northwestern University shall pay for necessary
relocation of the sewer installations in the portion
of Garnett Place to be vacated. As an alternative to
relocation, if Northwestern University elects to leave
the sewer installations in their present location, it
shall grant the City an easement for maintenance of
these sewer installations.

3._ That Northwestern University shall remove the present
curb returns and shall construct new curb and side-
walk along Maple Avsnu6,across thh portion of Garnett
Place to be vacated.
4. That Northwestern Unive sit,y,shall give the City an
appropriate written commitment that it will not apply
for a building permit for any construction on the
northern portion of the s-ite bounded by Emerson St-reet,
Maple Avenue, Foster Street, and the CTA right-of-way
until the graduato student housing now being constructed
on the southern portion of the site has been occupied
for a full college,gear, and the City, in cooperation
with Northwestern University, has had an adequate
opportunity to evaluate the traffic and parking effects
an the immediate neighborhood and the street t Vein.
Specifically, if 90% or more of the graduate h8using
units now being constructed are occupied by Qctober 1974,
Northwestern Universit agrees that it will not apply
prior to August 1, 1971 for a building permit for any
construction on the northern portion of the site unless
the City Council is satisfied earlier concerning the
traffic and parking effects and consents to an earlier
application date. If 90% or more of the graduate student
housing now being constructed is not occupied by October
1970, the building permit application date shall be ad -
gusted accordingly to allow for evaluation of the traf-
fic and parking effects during the equivalent of a Ball
college year or for such shorter.evaluation period as
is agreed to by the'City Council.
5. If the City on the basis of experience finds that a,
turnaround is necessary on Garnett place immediately
east of the CTA right»of-way, Northwestern University
shall construct the necessary turnaround in the manner
specified by the City.
SECTION 2: This ordinance shall take effect and
be in force and effect From and after
its passage and approval in the manner provided by law, sub,ect
to the condition that the City Clerk shall file or cause to be
filed for record in the office of the Recorder of Deeds of Cook
County, Illinois, a certified copy of this ordinance together
with the Plat made a part thereof.
