HomeMy WebLinkAboutORDINANCES-1969-00714-699 • • 0 I Revised 7.14-69 54-0-69 AN ORDINANCE Granting the Appeal of Irvin and Jean Klingler for a Variation from the Non- conforming Use and Nonconforming Building Regulations of the Evanston Zoning Ordi- nance, Adopted November 21* 1960. WHEREAS, the Zoning Hoard of Appeals held a public hearing on April 15, 1969 on the appeal of Irvin and Jean Klingler for a variation from the ponconforming use and building regulation, of the zoning ordinance to permit the retention of a nursing home beyond the elirdnation state of December 2# 1969 on the property located at 2306 Ridge Avenue, which is located in the R1 Single -Family Residence Districtl and WHEREAS, the Zoning Hoard of Appeals has recommended denial of said appeal; and IVHEREAS, the City Council has reviewed the evidence and is of the opinion that the variation should be granted subject to certain terms and conditions; and WHEREAS, the City Council has determined that granting the variation only for the time period as hereinafter limited will not alter the essential. character of the neighborhood in which the property is located; and WHEREAS, the City Council has determined that the plight of the owners is due to unique circumstances in that the use of the property as a nursing home must be discontinued on or before August 26, 1970, at which time the .licensing requirements of the state would no longer permit such operation, and the investment by the owners in said home would have to terminate at that. time, - and • WHEREAS, the evidence adduced indicates that there will n LJ be no depreciation of property values for the period granted in the surrounding area if the appeal is grantedl and WHEREAS, the City► Council has determined that the pro- posed variation will not impair an adequate supply of light and air to adjacent property► or substantially increase the danger of fire or otherwise endanger the public safety. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF E'VANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a variation from the noncon- forming use and nonconforming building regulations of the zoning ordinance adopted November 21, 1960, so far as said regulations pertain to the property located at 2306 Ridge Avenue, and legally described as w Lots 3 and 4 in Block I in Sewall Cleveland and Simmons Subdivision of the South 5 acres of that part of the North half of the Southwest quarter of Section 7, Township 41 North, Range 14, East of the Third Principal Meridian, lying west of Ridge Road, in Cook County, Illinois, is hereby granted to permit the retention of a nursing home on said property beyond the elimination date of December 2, 1966 for a period terminating on or before August 26, 1970. SECTION 2: That the variation herein granted is subject to the execution and recording by the applicant of a restrictive covenant in a form . 2.. It w • 43 SECTION 21 That the variation herein granted is subject to tha followino condi- tions (l) that said variation shall continue only during the lifetime of the existing structure f (2) that adequate legal off-street parking be required; (3) that a coy y of the contract of purchase of portion of said property be filed with the Planning and Development Comittee t (4) that plans for the construction of the now residence be subject to the approval of the Planning and Development Committee* 3ECTI 3: The Uirector of Building is hereby ordered and directed to grant such permits or certificates of occupancy as shall be required to effectuate the recommendations of the City Council # and the variation granted thereunder* SECTION 4: This ordnance shall: be in full force and effect from and a ftor its passage and approval in the manner provided by law.
