AN ORDINANCE
Granting the Appeal of Walter J. Woske
for a Variation from the Use Regulations
of the Zoning Ordinance, Adopted November
21, 1960.
WHEREAS, the Zoning Board of Appeals held a public hearing
on March 18, 1969 on the appeal of Walter J. Woske for a varia-
tion from the use regulations of the Zoning Ordinance to permit
the retention of four dwelling units in a building located in
the R2 Single Family Residence District at 1211 Harvard Terrace;
• and
WHEREAS, the Zoning Board of Appeals has recommended
denial of said appeal; and
WHEREAS, the City Council has reviewed the evidence and is
of the opinion that said variation should be granted in part
subject to certain terms and conditions; and
WHEREAS, the City Council has determined that the granting
of the variation will not alter the essential character of the
neighborhood in which the property is located; that there is
another two unit dwelling in the block, and that 11 property
owners in the neighborhood stated that they had no objection
to there being four units in the building at 1211 Harvard Terrace;
and

WHEREAS, the City Council has determined that the plight
of the owner is due to the unique circumstances that the property
was occupied for multiple family purposes when acquired and the
cost of restoring the premises to single family use would be
between $30,000 and $40,000; and
WHEREAS, the evidence adduced indicates that there has
been and there will be no depreciation in property values of
the surrounding area if the property is used under the conditions
herein provided; and
WHEREAS, the City Council has determined that a substan-
tial hardship would be worked upon the owners if they are re-
quired to convert the property to a single family dwelling unit;
• and
WHEREAS, The City Council has determined that the proposed
variation will not impair an adequate supply of light and air to
adjacent property or substantially increase the danger of fire
or otherwise endanger the public safety:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COCk COUNTY, ILLINOIS:
SECTION 1: That a variation from the use
regulations of the Zoning Ordinance
of the City of Evanston, adopted November 21, 1960, as far as
said regulations pertain to the property located at 1211 Harvard
Terrace in the City of Evanston, and legally described as -

The West 33% feet of Lot 8, in Block 2 in Evanston
Heights Subdivision in the Northwest quarter of
Section 30, Township 41 North, Range 13, East of the
Third Principal Meridian, according to the Plat
thereof recorded August 9, 1893 as Document 1913921,
in Cook County, Illinois,
is hereby granted to permit two dwelling units on said property.
SECTION 2: That the variation herein granted
is subject to the following con-
ditions:
(1) that there shall be no dwelling unit in the
basement; and
(2) that a covenant of agreement to the above con-
dition shall be submitted in recordable form
by the appellant.
SECTION 3: The Director of Building is hereby
ordered and directed to grant such
permits or certificates of occupancy as shall be required to
effectuate the recommendations of the City Council, and the
variation granted thereunder.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage
and approval in the manner provided by law.
