Yerkes for a Variation from the Lot Area Regu- lations of the Evanston Zoning Ordinance# Adopted November 21, 1960. WHEREASO the Zoning Board of Appeals held a public hearing on December 17s 1966 on the appeal of Charles A. Yorkes for a variation from the lot area regulations of the zoning ordinance to permit the subdivision of the property located at 1321 Asbiry Avenue into two lots to allow construction of a single family dwelling on Lot 1 of the proposed resubdivisi.on, leaving an existing two family dwelling on Lot 2; and IE,RCAS„ the Zoning Board of appeals has recommended denial of said -appeal; and WHEREAS* the City Council has reviewed the evidence and is of the opinion that said variation should be granted subject to certain terms and conditions i and WHEAF-AS# the City Council has determined that the grant- ing of the variation will not alter the essential character of the neighborhood in which the property is located since the additional lot will permit the construction of a new single family dwelling in a single family residence di.stricti and EREAS# the City Council has determined that the plight of the owner is due to the unique circumstances in that the size of the subject property is slightly under the required area of an adequate size to accommodate two structures; and WHEREAS# the evidence adduced indicated there will be no depreciation in property values of the surrounding area if the subject property is Improved with another family residence 0 structure; and F , N WHEREAS„ the alternate use of the subject property would be for an institutional, use which would be out of character with the surrounding area; and WHEREAS, the City Council has -determined that a substantial hardship would be worked upon the owner if he was unable to re- 1. subdivide the property and permit the construction of a now single family dwelling as proposed for the reason that a substantial portion of vacant property would remain unused while the remaining, portion could not continue to be used for the use permitted; and WHEREASp the City Council has determined that the proposed variationwi.l.l not impair an adequate supply of Light and air to adjacent property,or substantially increase the danger of fire or otherwise endanger the public safety. ILLINOIS t SE `ION l a That a variation from the lot area regulations of the Zoning Ordinance, adopted November 21, 1960# so far as said regulations pertain to the property located at 1321 Asbury Avenue# and legally described as w Lots 4 and 5# together with that part of Lot I lying east and adjoining said Lots 4 and 5, and west of the mast line of Lot 2 extended south to the south line of Lot 1# all In the subdivision of Lots i and 2 of Owner's subdivision of Block 44 of Evanston# in Section 18, Township 41 North* Flange 14, Zost of the Third principal Meridian In Cook County, Il.linois# and part of Section I30 Township 41 North, Range 13, East of the Third Principal Meridian* is hereby granted to permit the resubdivi.sion of said property into two lots to allow the construction of a single family dwelling on Lot 1 of than proposed resubdivi,sion leaving an • existing two family structure on Lot 2. SECTION 2: That the variation herein granted is subject to the following conditions: (1) that said variation shall continue only during the lifetime of the existing structure; (2) that adequate legal off-street parking be required; (3) that a copy of the contract of purchase of portion of said property be filed with the Planning and Development Committee; (4) that the plans for the renovation of the existing building be subject to the approval of the Planning and Development Committee; (5) that no building permit shall be .issued for any construction on the north lot until com- pletion of the renovation of the structure on the south lot; and (6) that a covenant of agreement to comply with these conditions shall be submitted in recordable form by the appellant. SECTION 31 The Director of Building is hereby ordered and directed to grant such permits or certificates of occupancy as shall be required to effectuate the recommendations of the City Council# and the variation granted thereunder. SECTION 4: This ordinance shall be in full Force and effect from and after its passage and approval in the manner provided by law.
