BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Code of the City of Evanston, 1957, as amended, be further amended by adding thereto Sections 22-24a through 22-24J to read as follows: "Sec. 22-24a. Creation of Board. There is hereby created the Evanston Mental Health Board • composed of seven members, including a Chairman. "Sec. 22-24b. Appointments. The members of the Board shall be appointed by the Mayor with the advice and consent of the City Council. Member- ship of the Board shall, as nearly as possible, be representative of interested groups of the community, such as the Health Department, medical societies, local welfare agencies, hospital boards, school boards, lay associations concerned with mental health or mental retardation, as well as labor, business and civic groups, and the general public. • L • -2 "Sec. 22-24c. Tenure of Board Iviembers -- Vacancies. The term of office of each Member of the Board shall be for four years, provided however that of the members first appointed, two shall be appointed for a term of two years; two for a term of three years; and three for a term of four years. All terms shall be measured from the first day of the year of appointment. Vacancies shall be filled for the unexpired term in the same manner as original appointments. "Sec. 22-24d. Removal of Board Members. Any Member of the Board may be removed by the Mayor for neglect of duties, misconduct, or malfeasance in office • after giving a written statement of the charges and an opportunity to be heard thereon. "Sec. 22-2`4e. Expenses of Board Members. Members of the Board shall serve without compensation, but the expenses incurred by any Member in the perform- ance of official duties shall be directly reimbursed to him from the Mental Health Fund. "Sec. 22-34f. Powers of Board. Subject to the provisions of the Community Mental Health Act, the Evanston Mental Health Board shall have the power to - (a) Review and evaluate mental health services and facilities in Evanston. • S,f • -3- (b) Submit to the Mayor and City Council a program of mental health services and facilities. (c) Within amounts appropriated therefor, execute such program and maintain such services and facilities as may be authorized under such appropriations, including amounts appropriated under bond issues, if any. (d) Enter into contracts for rendition or operation of services and facilities on a per capita basis or otherwise. (e) Arrange for the rendition of services and opera- tion of facilities by other agencies of the City of Evanston or the County of Cook with the ap- proval of the City Council. (f) Make rules and regulations concerning the rendi- tion or operation of services and facilities under its direction or supervision. (g) Employ such personnel as may be necessary to carry out the purpose of this ordinance and prescribe • the duties of such personnel. (h) Perform such other acts as may be necessary or proper to carry out the purposes of this ordi- nance consistent with the regulations of the Director of the State of Illinois Department of Mental Health. "Sec. 22-24g. Annual Budget. Annually, on or before October 15, the Board shall pre- pare and submit to the ;vlayor, City Council, and City Manager its annual budget showing the estimated receipts and intended disbursements for the fiscal year beginning the next January 1. The City Manager shall incorporate the Board's revenue estimates and appropriation requests in the proposed budget to be submitted on or before December 1 in each year to the City Council for its is 0 -4- review, revision, and adoption. The Board's annual budget shall be filed with the City Clerk on or before October 15 in each year and shall be available for public inspection. "Sec. 22-:24h. Annual Report. Annually, on or before January 30 in each year, the Board shall submit to the Mayor and City Council an annual report detailing the income received and dis- bursements made pursuant to this ordinance during the preceding fiscal year. The annual report shall be filed with the City Clerk on or before January 30 in each year and be available for public inspection. • "Sec. 22-24i. Establishment of Mental Health Division. There is hereby established a Mental Health Division in the Evanston -North Shore Health Department. There is also established the position of Chief of Mental Health Services. The incumbent in this position shall be responsible for the administrative direction and execu- tion of the mental health programs as authorized by the Board and appropriation ordinances adopted by the City Council, and he shall serve as the Executive Secretary of the Board. The Public Health Director shall be responsible for general administrative super- vision of the Mental Health Division and for coordina- tion of mental health programs and activities with other • 5 s1 0 -5- public health programs and activities administered by the Health Department. "Sec. 22-24j. Applicability of Laws, Regulations, etc. governing City Departments. The Board may employ such personnel as are authorized by the appropriation ordinance. All personnel of the Evanston Mental Health Board shall be recruited and governed by the Civil Service Act for Cities. Their positions shall be included in the City's position classification plan, and their compensation shall be provided for in the City's pay plan and be subject to the City's pay plan rules. All other laws, regulations, rules, policies, and procedures that govern City depart- ments under the administrative direction of the City Manager shall also apply to the mental health program and personnel assigned thereto except where such laws, regulations, rules, policies, and procedures are in conflict with the Community Mental Health Act. All legal, financial, personnel, and other staff services required by the Evanston Mental Health Board shall be provided by the City, and the City Manager is hereby authorized and directed to make appropriate arrange- ments for the prompt and satisfactory provision of such staff services." 0 -6- ScCTION 2: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
