Re: Docket 254-12E-69
Ordinance 73-0-69
Dear Mr. Anderson:
October 6, 1969
I have added the language to Ordinance 73-0-69
which appears in the Council minutes of September 29,
1969, on motion of Alderman Winfield.
I believe that this language is purely precatory
and has no legal effect on the City Council or the Zoning
Board in its subsequent deliberations on other properties.
• In my judgment, this language, although legal in the sense
that it is an expression of the Council's opinion, is not
desirable as it would tend to undermine the position of the
City Council and the Zoning Board, should they attempt to
refuse subsequent appeals.
I believe that such language is therefore undesirable
and ought to be avoided unless the City Council is prepared
to grant future appeals without requiring the same amount of
proof as normally required.
