WHEREAS, the City Council referred to the Zoning Amendment Committee for its consideration, the matter of certain amendments to the Evanston Zoning Ordinance concerning the following property: The properties within the boundaries commencing at the intersection of Oakton Street and `Dewey Avenue, thence south along Dewey Avenue to the first alley south of Oakton Street, thence west along said alley to the first alley west of Darrow Avenue, thence south along said alley to Mulford Street, thence east along Mulford Street to the first alley east of Wesley Avenue, thence north along said alley and the center line of said alley ex- • tended to Oakton Street, and thence west along Oakton Street to the point of origin. WHEREAS, a public hearing was held by the Evanston Zoning Amendment Committee on March 27, 1969, pursuant to notice and publication as required by law; and WHEREAS, the Evanston Zoning Amendment Committee rendered a report under date of August 19, 1969, recommending a change in 1 zoning of the said area; and WHEREAS, in the opinion of the City Council, the highest and best use of the properties would be to change the present R2 Single Family Residence District zoning to R1 Single Family Residence District, and that said change in the zoning would not adversely affect property adjacent thereto or in the immediate area; and • 79 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, as amended, be further amended as follows: That the following described properties now class- ified as R2 Single Family Residence District on the official District Map of the Evanston Zoning Ordinance are hereby zoned R1 Single Family Resi- dence District. The regulations and restrictions applicable to R1 Single Family Residence District and the penalties provided for in said Zoning Ordinance, adopted November 21, 1960, as amended, for a violation of any such regulations and restrictions, shall hereafter apply to the following area: The properties within the boundaries com- mending at the intersection of Oakton Street and Dewey Avenue, thence south along Dewey . Avenue to the first alley south of Oakton Street, thence west along said alley to the first alley west of Darrow Avenue, thence south along said alley to Mulford Street, thence east along Mulford Street to the first alley east of Wesley Avenue, thence north along said alley and the center line of said alley ex- tended to Oakton Street, and thence West along Oakton Street to the point of origin. SECTION 2: The official District Map of the Zoning Ordinance of the City of Evanston, as amended, shall be further amended in accordance with the pro- visions of this ordinance. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. - 2- • • SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. Anderson City Manager City of Evanston Re: Docket 254-12E-69 Ordinance 73-0-69 Dear Mr. Anderson: October 6, 1969 I have added the language to Ordinance 73-0-69 which appears in the Council minutes of September 29, 1969, on motion of Alderman Winfield. I believe that this language is purely precatory and has no legal effect on the City Council or the Zoning Board in its subsequent deliberations on other properties. • In my judgment, this language, although legal in the sense that it is an expression of the Council's opinion, is not desirable as it would tend to undermine the position of the City Council and the Zoning Board, should they attempt to refuse subsequent appeals. I believe that such language is therefore undesirable and ought to be avoided unless the City Council is prepared to grant future appeals without requiring the same amount of proof as normally required.
