HomeMy WebLinkAboutORDINANCES-1969-099-O-69• 8$ n�M AN ORDINANCE Granting the Appeal of Alan Saks for a Variation from the Front Yard Obstruction Regulations of the Evanston Zoning Ordi- nance, Adopted November 21, 1960. WHEREAS, the Zoning Board of Appeals held a public hearing on November 199 1968 on the appeal of Alan Saks for a variation from the front yard obstruction regulations of the zoning ordi- nance to permit the construction of a fence in the required front yard area which is not permitted in the R1 Single Family Residence District wherein this property is located; and WHEREAS, the Zoning Board of Appeals has recommended denial of said appeal; and • WHEREAS the City Council has reviewed the evidence adduced at said hearing and is of the opinion that said variation should be granted on certain conditions; and WHEREAS, the City Council has determined that the granting of the variation will not alter the essential character of the neighborhood in which the property is located since the proposed fence will allow the continued use of a front yard which will be surrounded by greenery and will conform with the pattern of the area; and WHEREAS, the granting of the variation will be beneficial to the public welfare in providing a beautification program for the area; and • 1. rX • WHEREAS, the City Council has determined that the plight of the owner is due to the unique circumstances in that the width of the property at the street is 100.15 feet, that the set back of the residence from Sheridan Road is 94 feet from the front lot line and approximately 112 feet from Sheridan Road, and that said property, with this wide expanse of front lot area, is located in an R1 Single Family Residence District; and WHEREAS, the City Council has determined that the proposed variation will not impair an adequate supply of light and air to adjacent property in that said proposed improvement will provide for an open space of 10 or 12 feet on each side and will not come within 16 feet of either neighbor's house, and in addition, will not increase or endanger the public safety. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF • THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a variation from the front yard obstruction regulations of the zoning ordinance of the City of Evanston, adopted November 21, 1960, so far as said regulations pertain to the property at 727 Sheridan Road in the City of Evanston, Illinois, and legally described as - Lot 1 of the Resubdivision of the South 40 feet of Lot 5 (measured on the West line of said Lot), all of Lot 6 and the North 10 feet of Lot 7 (measured on the West line of said Lot) and vacated alley 20 feet wide East of and adjoining said premises in Block 2 in Arnold and Warren's Addition to Evanston, a Subdivision of the Southwest fractional quarter of Section 20, Township 41 North, Range 14, East of the Third Principal Meridian; and also of the South 40 feet of Lot 28 (measured at right angles 0 -2 87 0 • to the south line of said Lot), all of Lot 29 and the North 10 feet of Lot 30 (measured at right angles to the North line of said Lot) in Block 2 in the Subdivision of Block 1 and the East half of the North 560 feet of Block 2 in Arnold and Warren's Addition to Evanston, according to the plat thereof recorded June 30, 1959 as Document 17583699; ALSO Easement for ingress and egress over the North 4 feet of the South 44 feet of Lot 5 (as measured on the West line thereof) and that part of the vacated alley 20 feet wide East of and adjoining said 4 feet in Block 2 in Arnold and Warren's Addition to Evanston a Subdivision of the South- west fractional quarter of Section 20, Township 41 North, Range 14, East of the Third Principal Meridian, for the benefit of Parcel 1, as created by agreement between Harlan B. Collins, Ruth D. Collins, his wife, Christian L. Strom and Alice N. Strom, his wife, Lorentz A. Johanson and Dorothy B. Johanson, his wife, and Frank M. Preucil and Marjorie W. Preucil, his wife, dated June 11, 1959, and recorded June 6, 1960, as Document 17872621, all in Cook County, Illinois, is hereby granted to permit the construction of a fence in the required front yard of the property at 727 Sheridan Road, Evanston, Illinois. SECTION 2: The Director of Building is hereby ordered and directed to grant such permits as shall be required to effectuate the recommendations of the City Council of the City of Evanston. SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
