Bryant for a Variation from the Use Regula- tions of the Evanston Zoning Ordinance, Adopted November 21, 1969. WHEREAS, the Zoning Board of Appeals held a public hearing on October 21, 1969 on the appeal of Edward J. and Mary L. Bryant for a variation from the use regulations of the Zoning Ordinance to permit a beauty parlor in the basement of the property located at 1117 Garnett Place, which use is not permitted in the R5 General Residence District wherein this property is located; and WHEREAS, the Zoning Board of Appeals has recommended denial of said appeal; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing and is of the opinion that said variation should • be granted on certain conditions; and WHEREAS, the City Council has determined that the granting of the variation will not alter the essential character of the neighborhood in which the property is located since the proposed use will be in the basement of the premises without any signs or other identification and will be operated solely by Mary L. Bryant; and WHEREAS, there are practical difficulties and particular hardship justifying the variation by reason of the fact that Edward J. Bryant is disabled and unable to be gainfully employed, or - 2- • and that Mary L. Bryant will have to discontinue the use of a present beauty parlor for economic reasons, and that because of her age and the condition of Mr. Bryant a hardship would exist if she was not permitted to operate the beauty parlor in her basement; and WHEREAS, the City Council has determined that the plight of the owner is due to unique circumstances relating to her professional activity and the age and physical condition of her husband; and WHEREAS, because of the remedies imposed by this ordinance, the proposed variation will not impair an adequate supply of light and air to the adjacent properties and will not depreciate the other properties in the neighborhood: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE • CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a variation from the use regula- tions of the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, so far as said regulations pertain to the property at 1117 Garnett Place in the City of Evanston, Illinois, and legally described as - Lot 7 in Resubdivision of Lots 20-28 and 71-74, inclusive, in J. B. Hobbs Subdivision of Part of the South half of the Northwest quarter of the Northwest quarter of Section 18, Township 41 North, Range 14, East of the Third Principal Meridian, in Cook County, Illinois, is hereby granted to permit a beauty parlor in the basement of the property at 1117 Granett Place, subject to the following r 0 -3- conditions: (1) that such use shall be limited to the life of ,Mary L. Bryant, owner of the property, or to the present ownership of the real estate or business by her; (2) That the beauty parlor shall be operated only by the said Mary L. Bryant; (3) That there shall be no signs used in connection with the use; and (4) That a covenant of agreement to the above condi- tions shall be submitted in recordable form by the appellants. SECTION 2: The Director of Building is hereby ordered and directed to grant such permits as shall be required to effectuate the recommendations of the City Council of the City of Evanston.
