HomeMy WebLinkAboutORDINANCES-1970-025-O-70'18 0 • Revised 3-30-70 Amended 5- 4-70 25-0-70 AN ORDINANCE Amending Sections 5-13, 5-19, 5-209 and 5-22 of the Code of the City of Evanston, 1957, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLNOIS: SECTION 1: That Section 5-13 of the Code of the City of Evanston, 1957, as amended, be amended to read as follows: "Any dog for which the license fee for the current year has been paid, which may during such year be impounded or taken up for being at large, may be redeemed by the owner upon the payment of two dollars ($2.00) per day as impounding fee, and one dollar and • fifty cents ($1.50) for all other animals; provided, however, that all such dogs taken up for being at large shall be held for 10 days unless satisfactory evidence of rabies inoculation is provided pursuant to the ordinances herein contained. If any such dog shall not have been redeemed by the owner hereof within 10 days after being impounded, the animal control warden may dispose of such dog." SECTION 2: That Section 5-19 of the Code of the City of Evanston, 1957, as amended, be amended by adding the following sentence to read as follows: "Any court of competent jurisdiction, upon finding that a dog is dangerous as herein defeined, may direct that such dog shall be given up and destroyed." SECTION 3: That Section 5-20 of the Code of the City of Evanston, 1957, as amended, be amended by adding the following sentences to read as follows: .7 - 2- "The owner of such biting dog shall have said dog examined by a licensed veterinarian pursuant to Sec. 5-22 of this chapter, within no later than 24 hours after such bite has occurred. Any person who violates this section shall be subject to a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense.'+ SECTION 4: That Section 5-22 of the Code of the City of Evanston, 1957, as amended, be amended to read as follows: "All animals which have attacked, bitten, scratched or otherwise injured any person so as to cause an abrasion or breaking of the skin of such person shall be impounded for a period of not less than 10 days. If, however, a licensed veterinarian or rabies in- spector receives information and evidence that the animal has been previously vaccinated in accordance • with the requirements of the State of Illinois, then said animal shall be confined either in a kennel under veterinary supervision, or said animal shall be con- fined to the house of the said owner and shall not be permitted upon the public streets, unless, in the judg- ment of the rabies inspector or the licensed veteri- narian, circumstances are such that the dog or other animal should be confined elsewhere. If said animal shall be confined within a private home, it shall not be permitted to leave the home of the owner unless such dog or other animal is under the supervision of an adult, but, under no circumstances shall such animal be permitted upon the public streets. It shall be presented for examination and observation by a licensed veterinarian on the first, fifth, and tenth days of a ten day period, commencing within 24 hours of the date of the bite. All reports of bites received by a veterinarian shall be reported in writing to the rabies inspector within 24 hours after the dog or other animal is confined and such report shall contain the owner's name, address, the date of confinement, the breed, description, age and sex of the dog or other animal. "Upon the completion of confinement of the dog or other animal for the 10 day period, the veterinarian shall notify the rabies inspector and the local health • department in writing of the final disposition of the dog or other animal. Failure to comply with the u • • • -3- provisions hereof shall subject the owner of such dog or animal to a fine of not less than twenty- five dollars ($25.00) nor more than five hundred dollars ($500.00) for each and every day that the violation continues." SECTION 5: Nothingto the contrary herein contained, the owner of a biting dog or other animal, having had his dog properly vaccinated for the first time, less than 30 days prior to the biting incident or where the dog or other animal has inflicted face wounds, it shall then be im- pounded for the full ten days at a licensed kennel or at the municipal impounding facility." SECTION 6: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
