HomeMy WebLinkAboutORDINANCES-1970-050-O-703 C. ,I E 50-0-70 AN ORDINANCE Granting the Appeal of Cosmopolitan National Bank of Chicago, as Trustee under Trust No. 14638, James Kane, Beneficiary, for a Varia- tion from the Lot Area Requirements of the Evanston Zoning Ordinance, Adopted November 21, 1960. WHEREAS, the Zoning Board of Appeals held a public hearing on April 21, 1970 on the appeal of Cosmopolitan National Bank of Chicago, as Trustee under Trust No. 14638, James Kane, Beneficiary, for a variation from the lot area requirements of the Zoning Ordi- nance to permit the construction of two single-family dwellings on the property commonly.known as 1834 Lemar Avenue, Evanston, • Illinois, each lot containing less than the minimum lot area of 5,000 square feet for a single-family dwelling; and WHEREAS, the Zoning Board of Appeals has recommended denial of said appeal; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing and is of the opinion that said variation should be granted WHEREAS, the City Council has determined that the granting of the variation will not alter the essential character of the neighborhood in which the property islocated since the block in which the subject lots are located consists primarily of single- family dwellings and the appellant will improve each of the subject lots with single-family dwellings; and 3G • WHEREAS, there are practical difficulties and particular hardship justifying the variation in that the level of real estate values in the neighborhood will not yield a fair economic return if the appellant is restricted to the construction of a single- family dwelling on the total area of the combined lots in an area which was overbuilt on substandard lots before the adoption of a modern zoning ordinance; and WHEREAS, the City Council has determined that the plight of the owner is due to the unique circumstances of the location of the subject lots in an area in which development in accordance with the requirements of the Zoning Ordinance is not economically justified • and that the subject property will remain unimproved without benefit of a variation from the lot area requirements. E NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a variation from the lot area require- ments of the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, so far as said regu- lations pertain to the property at 1834 Lemar Avenue in the City of Evanston, Illinois, and legally described as - Lots 39 and 40 in Block 3 in McIntosh's Church Street Addition to Evanston in the Southwest quarter of the Northwest quarter of Section 13, Township 41, North, Range 13, East of the Third Principal Meridian in Cook County, Illinois, is hereby granted to permit the construction of two single-family dwellings, one on each of the recorded lots. - 2- 366 • • • SECTION 2: The Director of Permits and Inspections is hereby ordered and directed to grant and issue such permits as shall be required to effect the prc isions of this ordinance as adopted by the City Council of the City of Evanston. SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
