AN ORDINANCE
Amending Section 28-5 of the Code
of the City of Evanston, 1957, as
Amended.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 28-5 of the Code of
the City of Evanston, 1957, as
amended, is hereby amended by adding thereto the following
subsection, to read as follows:
"A-310.4. - Sulfur Content Limitation. - No person
shall cause or permit the use, or if intended for use
in the City of Evanston, the purchase, sale, offer for
sale, storage or transportation, of fuel which, as
determined by the methods of the American Society for
Testing and Materials, contains more than the following
percentages of sulfur by weight:
For the period September 1, 1971 to August 31,
1972: 1.25 percent;
On and after September 1, 1972: 1.0 percent.
SECTION 2: That said Section 28-5 is further
amended by amending Subsection A-170.3
to read as follows:
"A-170.3. - Variations. - To grant variations from
the provisions of Subsection 310.4 and Subsections
320.0 through 330.122."

SECTION 3: That said Section 28-5 is further ;!
amended by amending Subsection A-170.31
to read as follows:
"A-170.31. - Standards for Variations. - The Appeal
Board may grant a variation from the requirements of
this code upon finding that compliance with any pro-
visions of Subsections 320.0 through 330.122, or any
decision of the Director, will result in an arbitrary
and unreasonable taking.of property or in the closing
and elimination of any lawful business, occupation or
activity if the Board shall determine that such taking
of property or closing or elimination will not result
in a benefit or advantage to the public in the reduction
of air pollution sufficient to justify such action.
In granting the variation, the Board may prescribe other
and different requirements applicable to the business,
occupation, activity or property involved, provided
that such requirements may not be more onerous or
stricter than those that would be imposed under the
provisions of this code. The Appeal Board may grant
a variation from Subsection 310.4 of this code because
of the unavailability of fuel permitted by Subsection
310.4; provided that no such variation shall be granted
for longer than one year."
SECTION 4: This ordinance shall be in full force
and effect from and after its passage,
approval and publication in the manner provided by law.
