AN ORDINANCE
Amending Sections 35-29, 35-30, 35-319
35-32, and 35-38, and Repealing Sections
35-339 35-349 35-35, 35-36, and 35-37 of
the Code of the City of Evanston, 1957,
as amended, Regulating Exhibitions of
Motion Pictures.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 35-29 is hereby
amended to read as follows:
"It shall be unlawful for any person to show or
exhibit in a public place, or in a place to which
the public is admitted anywhere in the City of
Evanston, any motion picture, whether an admission
fee is charged or not, without exhibiting a class-
ification notice therefor as provided in this
ordinance."
SECTION 2: That Section 35-30 is hereby
amended to read as follows:
"Sec. 35-30. Designation of Motion Pictures.
The classification notice required herein shall desig-
nate the rating applied to the motion picture to be
exhibited. Said classification notice shall contain
one of the following designations:
G -- All ages admitted. Picture suitable
for general audience.
GP -- All ages admitted. Parental guidance
suggested.
R -- Restricted. Any person under 17 requires
accompanying parent or adult guardian.
X -- Objectionable for persons under the age of
17. Any person under 17 requires accompany-
ing parent or adult guardian.

SECTION 3: That Section 35-31 is hereby ICI 5
amended to read as follows:
"Sec. 35-31. Nature of Ratings.
• Any motion picture which, because of its theme,
content or treatment, should not be presented to
persons under the age of 17 unless accompanied by
a parent or adult guardian, shall be designated
as 'R -- Restricted'. For the purpose of this
ordinance, such a picture shall include any motion
picture which, by reason of its treatment of sex,
violence, crime or profanity, may -be detrimental
to children.
Any motion picture which, because of its theme,
content or treatment, is objectionable for persons
under the age of 17 shall be designated 'X'. For
the purpose of this ordinance, such motion picture
shall include any motion picture which, when con-
sidered as a whole, has a calculated purpose or
dominant effect that is substantially to arouse
sexual desires and the effect of which is so great
as to outweigh whatever artistic or other merits
• the film may possess, and of which to a person
under 17 years of age, applying contemporary com-
munity standards, the dominant theme of the material
taken as a whole, appeals to prurient interests, or
because of its treatment of violence, crime or pro-
fanity, is objectionable for viewing by persons of
that age.
• It shall be unlawful for any person to show or ex-
hibit or cause to be shown or exhibited to any
person under the age of 17 any picture designated
'R' or 'X' unless accompanied by a parent or adult
guardian. Any person who admits a person not
qualified to view a motion picture under the
provisions of this ordinance to a performance of
a picture designated IR' or 'X' shall be presumed
to have violated the provisions of this ordinance.
Said prima facie case of violation may be rebutted
by a showing that the motion picture in question
has been improperly classified.
The rating herein provided shall be that imposed
upon said motion picture by the Motion Picture
Association of America, Inc. if the motion picture
has been classified by that organization. In the

event no classification has been imposed by said
motion picture association, the person or organ-
ization showing or exhibiting said motion picture
shall be responsible for designating the class-
ification in accordance with standards prescribed
by this ordinance, and shall restrict admission to
persons under the age of 17 in accordance with the
standards set forth in the above ratings."
SECTION 4: That Section 35-32 is hereby
amended to read as follows:
"Sec. 35-32. Posting of Classification.
The notice of classification provided for in this
ordinance shall be posted at or near the entrance
of the theatre, hall, room, or place where any
motion picture is being exhibited, at such a place
and in such a position that it may easily be read
by any person entering such theatre, hall, room,
or place, at any time when any such motion picture
is being exhibited."

35-36, and 35-37 are hereby

numbered Section 35-33.
SECTION 7: This ordinance shall be in full
force and effect from and after
its passage, approval and publication in the manner provided
by law.
