HomeMy WebLinkAboutORDINANCES-1970-086-O-70I AN ORDINANCE Amending Chapter 32 of the Code of the City of Evanston, 1957, As Amended, by Adding Thereto Section 32-15.3 WHEREAS, there has been repeated use of the residential streets of the City of Evanston for the purpose of vending ice cream and other food stuff by peddlers operating from motor vehicles; and WHEREAS, the continued operation of such peddlers has resulted in the increase of congestion in the streets, the disturbance of citizens during the nighttime hours, and has induced young children to enter upon the public streets, which • has caused additional traffic hazards and threatens the safety of such persons; and WHEREAS, it is in the best interest of the City of Evanston that the vendors of food stuff, operating from motor vehicles, be required to limit the frequency of their operation within a given area: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Chapter 32 of the Code of the City of Evanston, 1957, as amended, is hereby further amended by adding thereto Section 32-15.3 to read as follows: I 1'� 41L • l� "Sec. 32-15.3. Peddling of food products from the street. "It shall be unlawful for any person, firm or corporation to peddle food products from trucks or other vehicles on the public streets, side- walks or publicways of the city before the hour of 8 :00 A.M. and after the hour of 9 :00 P.M. "The vehicles used for such peddling shall not be permitted to park or stand in any location on the public streets except where the parking of motor vehicles is permitted under the provisions of this code, and the parking or standing of such vehicles on the streets or publicways except in lawful parking places is prohibited. The vehicle of such peddler shall not be permitted on the public streets within a given block for more than one period not to exceed one-half hour during any calendar day. "For the purpose of this ordinance, a block shall be that portion of the public street lying between two intersecting streets." SECTION 2: Any person, firm or corporation who violates the provisions of this ordinance shall be fined not less than $25.00, nor more than $500.00 for each violation. SECTION 3: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
