HomeMy WebLinkAboutORDINANCES-1970-084-O-70b$ • • • • • • Amended 10-19-70 •• • E AN ORDINANCE Granting the Appeal of Harry Omartian 1 ,51 5 for a Variation from the Use Regula- tions of the Evanston Zoning Ordinance, Adopted November 21, 1960. WHEREAS, the Zoning Board of Appeals held a public hearing on August 18, 1970 on the appeal of Harry Omartian for a varia- tion from the use regulations of the Zoning Ordinance to permit the retention of a third dwelling unit in the basement of the property located at 1628 Washington Street, which use is not permitted in the R3 Two Family Residence District wherein this property is located; and WHEREAS, the Zoning Board of Appeals has recommended denial of said appeal; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing and is of the opinion that said varia- tion should be granted on certain conditions; and WHEREAS, the City Council has determined that the granting of the variation will not alter the essential character of the neighborhood in which the property is located since the base- ment unit has been in existence and in use since the date of ownership of the property by the appellant, Harry Omartian, and will be used solely and exclusively by Mr. Omartian; and WHEREAS, there are difficulties and particular hardship justifying the variation by reason of the fact that Mr. Omartian 61, • • • • • • is presently retired and is living on a fixed income, and has resided in the building in which the use is located on and off for a period of 48 years; and WHEREAS, the City Council has determined that the plight of the owner is due to his advanced age and physical condition; and WHEREAS, the proposed variation will not impair an ade- quate supply of light and air to the adjacent properties and will not depreciate the other properties in the neighborhood: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: 166 SECTION 1: That a variation from the use regula- tions of the Zoning Ordinance of the City of Evanston, adopted November 21, 1960, so far as said regulations pertain�to the property at 1628 Washington Street, Evanston, Illinois,,/ and legally described as - The East 33 `1/3 feet of Lot 8 in Block 10 in Pitner and Sons' Second Addition to South Evanston in the Southeast quarter of Section 24, Township 41 North, Range 13, East of the Third Principal Meridian, Cook County, Illinois, is hereby granted to permit the retention and use of the base- ment dwelling unit, subject to the following conditions: 1. that said use shall be permitted only while the premises are occupied and owned by Harry Omartian; and 2. that a covenant of agreement to the above condi- tion shall be submitted in recordable form by the appellant. SECTION 2: The Director of Inspections and Permits is hereby ordered and directed to grant such permits as shall be required to effectuate the recommenda- tions of the City Council of the City of Evanston. -2- • • • • • • SECTION 3: This ordinance shall be in full forc6 let 7 and effect from and after its passage and approval in the manner provided by law.
