WHEREAS, the Zoning Board of Appeals held a public hearing on January 19, 1971 on the application of John L. Hartman for a special use permit to allow the retention of a fence in the required front yard of the property located at 1518 Davis Street, Evanston, Illinois, situated in an R3 Single Family Residence District, which is not a permitted use in such district; and WHEREAS, the Zoning Board of Appeals has recommended denial of said application; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing and is of the opinion that a special use permit should be granted for a period of two years; and WHEREAS, the City Council has determined that the granting of a special use permit will not alter the essential character of the neighborhood in which the property is located if permitted for a limited time; and WHEREAS, the subject fence was erected to prevent traffic across the front yard after attempts to establish a hedge had failed, and that the hedge could be established within two years; and WHEREAS, the applicant erected the subject fence in ignorance of the Zoning Ordinance and intends to plant a permanent hedge; and 0 0 �j WHEREAS, the continuation of the fence would provide protection for the new plantings until a strong, permanent hedge is established: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That a special use permit be and it is hereby granted to permit the retention of a fence at 1518 Davis Street, Evanston, and legally described as - The East 45 feet of the West 95 feet of Lots 1 and 2 in Block 8 in Hinman's Addition to Evanston in the Northwest quarter of the Southeast quarter of Section 13, Township 41 North, Range 13, East of the Third Principal Meridian in Cook County, Illinois, for a period of two years from and after the adoption of this ordinance. SECTION 2: The Director of Inspections and Permits is hereby ordered and directed to grant a special use permit so as to permit the retention of the fence on the subject property for a period of two years from the date of the adoption of this ordinance. SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. Introduced March 1 , 1971 Adopted March 8 Attest: /s/ Maurice F.
