HomeMy WebLinkAboutORDINANCES-1971-021-O-71-14 'q3 11 it 0 ;.?evised 3-1-71 21-0-71 AN ORDINANCE Amending Sections IV, V, VI, IX, X, and XII of the Evanston Zoning Ordi- nance, Adopted November 21, 1960. WHEREAS, the several departments of the City of Evanston have been reorganized and certain functions transferred to different departments, and new titles have been established for several departments and department head titles changed; and WHEREAS, reference to administrative responsibilities in the Zoning Ordinance should -reflect the proper titles and functions of departments: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Sections IV.J.6.d.; V.B.; VI.A.2.d.; IX.A.I.; X.B.9.c.3.; X.B.12.; XII.B.2, and XII.B.3 of the Zoning Ordinance, adopted November 21, 1960, as amended, be further amended by substituting the words "Director of Inspections and Permits" for the words "Director of Building." SECTION 2: That Section XII.C.3.a. of the Zoning Ordinance, adopted November 21, 1960, as amended, be further amended by substituting the words "Plan- ning Department" for the words "Department of Planning and Con- servation." 114, • SECTION 3: That Sections XII.C.3.c. and XII.C.3.d. of the Zoning Ordinance, adopted November 21, 1960, as amended, be further amended by substi- tuting the Jvords "Planning Director" for the words "Department of Planning and Conservation." SECTION 4: That Section XII of the Zoning Ordi- nance, adopted November 21, 1960, as amended, be further amended by substituting the words "Director of Inspections and Permits" for the words "Director of Building" or ":director of Planning and Conservation" in the following sections: Sect"i.on XII,D.1. X11. 1D. 2. Xl l. D. 3. " XI.r. D.4. " XI I* F. 2, SECTION 5: That Section XII.r.5. of the Zoning Ordinance, adopted November 21, 1960, as amended, be further amended by substituting the words "Director of Inspections and Permits and the Planning ;director" for the words "Director of Building and the Director of Planning and Conservation." SECTION 6: That the last paragraph of Section X.B.9.c. of said zoning ordinance be amended by substituting the following language: "Any exception granted in regard to the above types of cases shall be made in writing by the Director of Inso.ections and Permits. Copies of the exception granted, together with a state- ment in regard to the required findings and con- ditions and any other relevant documentation shall be provided to the property owner and shall be kept on file in the Department of Inspections and Permits." . -2 YS' • SECTION 7: That Section Y.II.A. of said zoning ordinance be amended to read as follows: "A. ENFORCING OFFICERS The Director of Inspections and Permits and the Planning Director of the City of Evanston, to- gether with their authorized representatives, are hereby designated to enforce this ordinance. 1. Director of Inspections and Permits In furtherance of this authority and in addition to the duties designated to him under the Building Code and other ordi- nances, the Director of Inspections and Permits and his authorized representatives shall: a. receive applications for building or erection permits for the construction, erection, alteration, enlargement, and removal of buildings, structures, and - signs; receive applications for per- mits of any premises for a parking lot, open sales dot, or other purposes where a building permit is not required; issue applied for as soon as practicable where the plans are found to comply with the provisions of this ordinance and all other laws and ordinances applicable thereto; make and maintain records thereon; b. receive applications for certificates of use and occupancy for buildings, s'L:r.uctures, and signs, for which build- ing or erection permits have been is- sued. and .^Ahich hive been constructed, erected, altered, enlarged or moved in accordance with such permits and are read••/ use and occupancy; receive applications for certificates of use and occupancy for any premises developed or improved as a parking lot, open sales lot, or other purposes where a building permit is not required; issue certificates of use and occupancy applied for as soon as possible after verification of each written application; • -3- I rl. C. receive applications for zoning excep- • ;tion certificates for special uses creak•=d by the adopt)on of this ordinance and for bu-;ld.in;s; structures, and land which become under the provisions of this o%rd .nance; determine the normal useful l i r e of a l l non- conform-ing buildings and structures subject to elimination in accordance with the pro- visions of Section XI; issue zoning ex- ception certificates applied for as soon as possible after verification of each application. Where the use and occupancy of the buildings, structures and land are subject to elimination, certificates shall be issued only for such periods of time as are established by the provisions of Section XI of this ordinance; d. conduct inspections of buildings, structures, and uses of any premises to determine com- pliance with the temps of this ordinance and issue certificates of inspection where compliance with the ordinance has been verified; e. conduct inspections of buildings, structures, signs and uses of any premises to determine compliance with the terms of any application, permit, or certificate issued by his office; f. maintain permanent and current records of this ordinance including, but not limited to, all amendments and official actions on all zoning exception certificates, cer- tificates of inspection, special uses, variations, appeals, and applications therefor; g. pi7.•avide such clerical and technical assis- tance as may be r. egu..Yri;d by the Board of Appeals in the exerc-i.se of its duties; and h. make an annual report to the City Manager on the work of the Department of Inspections and Permits on the enforcement of this ordinance. 2. Planning Director In furtherance of the authority conveyed by this ordinance, and in addition to all other duties designated to him, the Planning Director and his authorized representatives shall: 0 -4- i q7, a. receive petitions for proposed zoning amendments and provide such clerical and technic, 1. assa.stance as ntay be required by the Zoninq Amendment Committee in the exercise of -±t:s duties; and b. maintain permanent and current records of all functions of the Planning Department related to the administration of this ordinance, including, butnot limited to, official actions on all amendments, and applications therefor." SECTION 2: That all ordinances or parts of ordi- nances in conflict with the provisions of this ordinance are hcxcby repealed. SECTION 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
