AN ORDINANCE
Granting the Appeal of the Evanston Trust
and Savings Bank, as Trustee under Trust
No. 736, for a Variation from the Use
Regulations of the Evanston Zoning Ordinance
WHEREAS, the Zoning Board of Appeals held a public hearing
on May 19, 1970 on the appeal of the Evanston Trust and Savings
Bank, as Trustees under Trust No. 736, Wesley 0. Wigginton,
Ruth Carlson Wigginton, Manly K. Hunt, and James H. Wigginton,
Beneficiaries, for a variation from the use regulations of the
Zoning Ordinance to permit retention of 23 dwelling units on the
property located at 1141-1143 Hinman Avenue, Evanston, Illinois,
• constituting 2 dwelling units in excess of that allowed in the
zoned R1 Single -Family Residence District; and
WHEREAS, the Zoning Board of Appeals has recommended
denial of said appeal; and
WHEREAS, the City Council has reviewed the evidence adduced
at said hearing and is of the opinion that said variation should
be granted for a limited time; and
WHEREAS, the City Council has determined that the granting
of the variation will not alter the essential character of the
neighborhood in hick the property is located since the addi-
tional dwelling units have been in existence and occupied for
over 40 years; and
WHEREAS, the plight of the owner is due to unique circum-
stances in that additional units have been in existence over 40

years; and
WHEREAS, the continued use of the building for 23
dwelling units for a limited period of time would not
depreciate other properties in the neighborhood:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That a variation from the use
regulations of the Zoning
Ordinance of the City of Evanston, adopted November 21, 1960,
so far as said regulations pertain to the property at 1141-1143
• Hinman Avenue, Evanston, Illinois, and legally described as -
0
Lots 21 and 22 in Block 78 in Village of Evanston,
in Section 19, Township 41 North, Range 14, East
of the Third Principal Meridian in Cook County,
Illinois,
is hereby granted to permit the retention of 23 dwelling units,
subject to the following conditions:
(1) that the 2 dwelling units, added in 1927
and 1931 respectively, shall be eliminated
after the expiration of three years from
the date of the passage of this ordinance;
and

(2) that the Trustee and Beneficiaries of the
subject property execute a covenant of
agreement, to run with the land, to condition
one, which shall be submitted in recordable
form to be filed with the Recorder of Deeds
of Cook County, Illinois.
SECTION 2: This ordinance shall be in full
force and effect from and after
its passage and approval in the manner provided by law.
