AN ORDINANCE
Amending the Code of the City of Evanston,
1957, as Amended, by Adding Article III,
Adopting the BOCA Basic Plumbing Code,
1970 Edition
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Chapter 10 of the Code of
the City of Evanston, 1957, as
amended, is hereby amended by adding Article III to read as
follows:
"ARTICLE III. Plumbing Code.
Pursuant to authority granted by the Illinois
Revised Statutes, 19690 Division 3 of Article 1
of Chapter 24, the City hereby adopts by refer-
ence as criteria for the issuance of construction,
reconstruction, alteration or installation permits,
the provisions of the BOCA Basic Plumbing Code of
Building Officials and Code Administrators Inter-
national, Inc., 1970 Edition, Sections P-100.1 to
P-1803.0 and Appendices A to C, inclusive, pro-
vided that the following sections are amended to
read as follows:
Section P-308.2. Public System Available.
A public water supply system and/or public sewer
system shall be deemed available to premises used
for human occupancy if such premises are within
1000 feet, measured along a street, alley, or ease-
ment, of the public water supply or sewer system and
a connection conforming with the standards set forth
in this code may be made thereto.
Section P-313.3. Freezing.
Water service piping and sewers shall be installed
below recorded frost penetration but not less below
grade than five (5) feet for water piping and four (4)

. feet of sewers. Plumbing piping in exterior
building walls shall be adequately protected against
freezing by insulation or heat or both.

Section P-405.23. Building Sewer.
a. In a Trench Separate From Water Service: If
the building sewer is installed in a trench
separate from the water service, the sewer
pipe shall be of cast iron, concrete, vitri-
fied clay tile, bituminized fiber, plastic,
asbestos cement, copper tube of a weight not
less than that of copper water tube Type L,
hard temper. Joints shall be watertight and
root -proof.
b. In Trench With Water Service. If the building
sewer is installed in the same trench as the
water service, the conditions of Section
P-1602.21 shall be met.
Section P-1602.1. Size of Water Service.
The water service pipe shall be of sufficient size to
furnish water to the building in the quantities and
at the pressure required elsewhere in this code. It
shall in no case be less than one (1) inch nominal
diameter. One method for sizing the water service
pipe is described in Appendix A.
Section 10-15. No plumbing work of any kind shall be
done in the City of Evanston except in compliance
with the Illinois Plumbing License Law, Ch. 111%0
§ 116.36 to 116.75, Ill. Rev. Stats., 1969.
Section 10-16. Any reference in said code to "admin-
istrative authority" shall be read as meaning the
"Director of Inspections and Permits."
Section 10-17. No licensed plumber shall perform
plumbing work in the City of Evanston except for
minor repairs unless prior thereto he shall have
on file in the office of the City Clerk, a bond in
the sum of $10,000 with sureties conditioned, among
other things, that the applicant will indemnify and
save harmless the City of Evanston from all claims
or damages arising from any negligence and unskill-
fulness in the execution or protection of his work
and from any unfaithful or inadequate work done by

virtue of any permit that may be issued to him by
the Department of Inspections and Permits, and
also if required by the City of Evanston, restore
streets, sidewalks and pavements over any piping
he may lay, and fill all excavations made by him,
so as to leave said streets, sidewalks and pave-
ments in as good state and condition as he found
them, and will keep and maintain the same in good
order for a reasonable time thereafter, to the
satisfaction of the Street Department of the City
of Evanston, and further conditioned that he will
pay all fines that may be imposed upon him for any
violation of any ordinance, rule or regulation
adopted by the municiplaity, and that he will con-
form to all the lawful regulations of the munici-
pality pertaining to the business of plumbing.
Section 10-18. Regulations of the BOCA Plumbing Code
of the City of Evanston and provisions of the ordinance
shall apply to all matters concerning design, install-
ation, alteration, addition, repair, removal, construc-
tion, use, location, and maintenance of plumbing systems.,
including sanitary and storm drainage, sanitary facil-
ities, water supply, storm and sewage disposal in
servicing existing or proposed buildings or structures
in the City. Three copies of the BOCA Basic Plumbing
Code, 1970 Edition, adopted by reference in Section
• 10-14 of this ordinance shall be filed in the office
of the City Clerk and kept available for public use,
inspection and examination.
The intention of the City Council is hereby expressed
that the provisions of this ordinance are severable
and that the invalidity of any section hereof or any
portion of any section hereof shall not affect any
other section or portion of this ordinance.
Section 10-19. Permit Fees.
Fees for permits required by the provisions of the
Evanston Plumbing Code shall be those established by
Ordinance 19-0-71, as amended.
Section 10-20. Penalty for Violations.
Any person who shall violate any provisions of the
BOCA Plumbing Code or any other provisions of this
ordinance, or who shall fail to comply with any of
the requirements thereof, or who shall design, in-
stall, alter, add, repair, remove, construct, use,
locate, or maintain any plumbing system in violation

of any approved plan or direction of the Director
of Inspections and Permits, of any permit or
certificate issued under the provisions of the
BOCA Basic Plumbing Code, shall be guilty of an
offense punishable by a fine of not less than
twenty-five dollars nor more than five hundred
dollars, and by a fine of not less than fifty
dollars nor more than five hundred dollars for
each and every subsequent offense. Each day that
an offense continues shall be deemed a separate
offnese."
SECTION 2: The Plumbing Ordinance of the
City of Evanston, adopted by the
City Council on July 16, 1951, as amended, is hereby repealed
and all other ordinances in conflict herewith are hereby
repealed.
SECTION 3: That this ordinance shall be in
full force and effect from and
after its passage, approval and publication in the manner
provided by law.
