HomeMy WebLinkAboutORDINANCES-1971-093-O-7110-13-71 • 93-0-71 AN ORDINANCE Amending Sections 27-97 and 27-98 of the Code of the City of Evanston, 1957 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON COOK COUNTY, ILLINOIS: SECTION 1: That Sections 27-97 and 27-98 of the Code of the City of Evanston, 1957, as. amended, be and the same are hereby amended so as to read as follows: "Section 27-97: To facilitate the cleaning of streets and public thoroughfares within the City of Evanston, the City of Evanston is hereby divided into six districts. It shall be unlawful, where parking is not otherwise prohibited, for any person to stop, stand, park or leave unattended a motor vehicle on any street or public thoroughfare within the districts hereafter described between the hours of 2:00 o'clock A.M. and 6:00 o'clock A.M. on the days and months as ov follows: A) DISTRICT ONE: All that part of the City lying easterly of the west line of Ridge Avenue and southerly of.a line commencing at a point, being the intersection of the north line of Main Street and the west line of Ridge Avenue, thence easterly along said north line of Main Street to the center line of the right-of-way of the Milwaukee Division of the Chicago and North Western Railway Company, thence northerly along the center line of said right-of-way to the north line of Lee Street, thence east along said north line of Lee Street, to the east city limits; 1) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction on each Monday; 2) on the west side of all streets and public thoroughfares extending in a northerly and southerly direction on each Tuesdav; 3) on the north side of all, streets and public thoroughfares extending in an easterly and westerly direction on each �Nfednesda ; • 4 on the east side of all streets and public thoroughfares extending in a northerly and southeriy.direction on each Thursday; 5) the regulations in District One shall be in force throughout the entire year. B) DISTRICT TWO: All that part of the City lying south of the north line of Main Street and west of the west line of Ridge Avenue: During the months of April, May, June, July, August, September, October and November as follows: a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction on the west side of all streets and public thoroughfares extending in a northerly and southerly direction on each Monday; b) on the north side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on each Tuesday; C) DISTRICT THREE: All that part of the City lying north of the north line of Lee Street extended, and east of the line commencing at a point being the intersection of the center line of the right- of-way of the Milwaukee Division of the Chicago and North Western Railway Company and the north line, extended west, of Lee Street, thence northerly along said center line of said right- of-way to its intersection with the west line of Ridge Avenue, thence northeasterly along said west line of Ridge Avenue to the city limits, thence east to the center line of Sheridan Road, thence north along the center line of Sheridan Road -to the city limits: During the months of April, May, June, July, August, September, October and November, as follows: a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a northerly and southerly direction on each Tuesday; b) on the north side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on each Wednesday. D). DISTRICT FOUR.: All that part of the City lying west of the center line of the right-of-way of the Milwaukee Division of the Chicago and North Western Railway Company south of the north prop- erty line of Church Street and north of the north property line of Main Street: During the months of April, May, June, July, August, September, October and November, as follows: a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a northerly and southerly direction on each Wednesday_; r b) on the north side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on each Thursday. E) DISTRICT FIVE: All that part of the City lying westerly of a line described as follows: com- mencing at a point being the west City limits and the center line of the north shore channel of the Sanitary District of Chicago; thence northeasterly along said center line of said Channel to its intersection with the center line of the right-of-way of the Milwaukee Division of the Chicago and North.Western Railway Company; thence northwesterly along said center line of said right-of-way to the north City limits: • -3- • During the months of April,Pfiay, June, July, August, September, October and November, as follows: a •a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a northerly and southerly direction, on each Thursday; b) on the north side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on each Friday. F) DISTRICT SIX: All that part of the City lying north of the north property line of Church Street, easterly of a line described as follows: com- mencing at a point being the intersection of the north property line produced west of Church Street and the west City limits; thence north along said west City limits to its intersection with the center line of the North Shore Channel of the • Sanitary District of Chicago; thence northeast- erly along said center line of said Channel to its intersection with the center line of the - right -of -way of the Milwaukee Division of the Chicago and North Western Railway.Company; thence northwesterly along said center line of said right-of-way to the north City limits; also westerly of a line described as follows:..com- mencing at a point being the north property line of Church Street and the center line of the right-of-way of the Milwaukee Division of the Chicago and North liVestern Railway Company; thence northwesterly along said center line of said right-of-way to its intersection with the west property line produced south of Ridge Avenue; thence northeasterly along the west property line of Ridge Avenue and the same produced north to the north City limits: During the months of April, May, June, July, August, September, October and November, as follows: 0 -4- a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction, and on the west side of all streets and public thoroughfares extending in a ,northerly and southerly direction on each Friday; b) on the north side of all streets and public. thoroughfares extending in an easterly and westerly direction, and on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on each Monday. "Section 27-98.0: To facilitate the cleaning of and snow removal from streets and public thoroughfares within Districts 2, 3, 4, 5 and 6, of the City of Evanston, as defined in Section 27-97, it shall be unlawful, where parking is not otherwise prohibited, for any person to stop, stand, park, or leave un- attended a motor vehicle on any street or public thoroughfare from December 1 to March 31, inclusive, between the hours of 2:00 A.M. and 6:00 A.M., as follows: a) on the south side of all streets and public thoroughfares extending in an easterly and westerly direction on Monday, Wednesday and Friday of each week; b) on the north side of all streets and public thoroughfares extending in an easterly and westerly direction on Tuesday. Thursday and Saturday of each week; c) on the east side of all streets and public thoroughfares extending in a northerly and southerly direction on Monday, Wednesday and Friday of each week; d) on the west side of all streets and public thoroughfares extending in a northerly and southerly direction on Tuesday. Thursday and Saturday of each week. "Section 27-98.1: To facilitate the cleaning of and removal of snow from streets and public thoroughfares in District One of the City of Evanston, as defined in Section 27-97 of this Code, it shall be unlawful, where parking is not otherwise prohibited, for any personto stop, stand, park or leave unattended a -.1o5 • motor vehicle on any street or public thoroughfare - during a snow emergency, except that parking will be permitted on the even numbered side of residential streets for 24 hours following a snow emergency. "Section 27-98.2: A Snow Emergency i.s hereby declared to be in effect immediately after two inches of snow has accumulated and will remain in effect 48 hours thereafter or until the snow has been plowed to the curb lines on any portion of -the affected streets or public thoroughfares. "Section 27-98.3: To facilitate completion of plowing, ;those vehicles parking on the even numbered side of the street after a snow emergency is in effect shall be moved to the odd numbered side within 12 hours after the snow has been plowed to the curb lines of the odd numbered side of the street. "Section 27-98.4: During the period of snow emergency the provisions of Section 27-97, as they pertain to District One, shall be suspended., "Section 27-98.5: No to be deposited any thoroughfare on that cleared or scheduled accumulation. person shall deposit or czuse snow upon any street or public portion of the traveled way for clearance of any snow "Section 27-98.6: No snow shall be deposited on any street of the city in such a manner as to obstruct a public sidewalk nor shall it be deposited upon a neighboring parkway or other private property so as to obstruct clear view at the intersection of traveled roadways. "Section 27-98.7: Any person, firm or corporation who violates any of the provisions of Sections 27-97 and 27-98, inclusive, of the,Code of the City of Evanston, 1957, shall be guilty of a mis- demeanor, punishable by a fine of not less than $3.00, nor more than $200. Any violator may avoid prosecution for violating this ordinance by paying to the Clerk of the Circuit Court, the minimum penalties herein provided, and before legal action has been brought against the violator, surrendering the traffic ticket or other notice of violation, either received or placed upon such vehicle. Any person making such payment shall receive a receipt therefor from the Clerk of the Circuit Court." 0 -6- �4' • • SECTION 2: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Intention of the City Council is hereby expressed that the provisions of this ordinance are severable and that the invalidity of any section hereof or of any portion of any section hereof, shall not affect any other section or portion of section of this ordinance. SECTION 3: This ordinance shall be in full force and effect 30 days from and after its passage, approval and publication in the manner provided by law.
