AN ORDINANCE y
Granting a Special Use Permit to
Joseph S. Doherty
WHEREAS, the Zoning Board of Appeals held a public hearing
on September 21, 1971 on the application by Joseph S. Doherty for
a Special Use Permit to allow the installation of a fence in the
required front yard of the property located in the R6 General
Residence District; and
WHEREAS, the Zoning Board of Appeals has recommended
denial of said appeal; and
WHEREAS, the City Council has reviewed the evidence adduced
at said hearing and is of the opinion that said Special Use
• Permit should be granted on certain conditions; and
WHEREAS, the City Council has determined that the granting
of a Special Use Permit to allow the installation of a fence in
the required front yard will result in the installation of a
fence so designed, located and maintained that the public health,
safety and welfare will be protected in that the proposed fence
will consist of pickets with ample space between pickets and
limited height so as to permit an unobstructed view of the
property and that the pickets will be blunted at the top and the
fence will be sturdy enough to withstand a heavy force without
collapsing; and
WHEREAS, the installation of such a fence will not cause
appreciable injury to the value of other property in the neighbor-
hood in which it is located since the fence will complement the

colonial architecture of the principal building and will not
detract from the appearance of the neighborhood and will blend
well with other existing fences.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That a Special Use Permit to allow the
installation of a fence in the required
front yard of the property located at 1101 Oak Avenue, Evanston,
Illinois, and legally described as -
Lot 1 in Burgener's Resubdivision of Lot 13 in
Block 1 in Union Addition to Evanston in the
Northwest quarter of the Northwest quarter of
Section 19, Township 41 North, Range 14, East of
the Third Principal Meridian in Cook County,
Illinois,
is hereby granted subject to the condition that the fence shall
not exceed 30 inches in height, and subject to compliance with all
other provisions of the Zoning Ordinance and other applicable laws.
SECTION 2: The Director of Inspections and Permits,
upon proper application, is hereby
ordered and directed to grant such permit as shall be required
to establish the Special Use herein granted.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage
and approval in the manner provided by law.
