AN ORDINANCE - 3 3 D
• Granting the Application of Frank Abarbanell
and Charlotte Abarbanell, his wife, for a
Variation from the Yard Obstruction Provis-
ions of the Zoning Ordinance and for a
Special Use Permit
WHEREAS, the Zoning Board of Appeals has recommended that
the application of Frank Abarbanell and Charlotte Abarbanell,
his wife, for a special use permit to allow retention of a
see -through wire -link fence in the required front yard in a two-
family residence district (R3) on the property located at 400
Asbury Avenue, Evanston, Illinois, be granted; and
WHEREAS, the Zoning Board of Appeals has recommended that
the application of Frank Abarbanell and Charlotte Abarbanell,
his wife, for a variation from the zoning ordinance to permit
• the retention of a see -through wire -link fence over-30 inches in
height within 20 feet of the lot corner formed by two intersecting
streets on the property located at 400 Asbury Avenue, Evanston,
Illinois, be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the recommendations of the Zoning
Board of Appeals are hereby confirmed
and the Director of Inspections and Permits is ordered and
directed to grant a permit to Frank Abarbanell and Charlotte
Abarbanell, his wife, to allow the retention of a see -through
wire -link fence in the required front yard on the property
• located at 400 Asbury Avenue, a two-family residence district,
zoned R3.

SECTION 2:

That a variation from the yard obstruction
provisions of the zoning ordinance,
adopted November 21, 1960, as amended, insofar as said regula-
tions pertain to the property located at 400 Asbury Avenue is
hereby granted to permit the retention of a'see-through wire -link

fence over 30 inches in height within 20 feet of the lot corner,
formed by the intersection of Asbury Avenue and Kirk Street,

in Evanston, Illinois.
SECTION 3: That the variation and special use permit
described herein pertain to the property
legally described as -
All that part of Lots 1 and 2 in Delaware Village
being a resubdivision of Lots 5 to 9 inclusive, in
Block 3 in Kelly and O'Briens South Evanston Sub-
division of the South half of the North half of the
North East quarter of the North East quarter of
Section 25, Township 41 North, Range 13, East of
the Third Principal Meridian except that part of
said lots lying East of a line 40 feet West of and
• parallel with the East line of said Section 25,
lying East of a line drawn from a point in the South
line of said Lot 1, 51.21 feet West of the South
-Eas.t corner thereof.to a point in the North line of
said Lot 2, 54.40 feet West of the North East corner
of said Lot 2 in the City of Evanston, Cook County,
Illinois: ALSO, the South 26.03 feet (as measured
at right angles to the South line of Lot 1) of the
West 22 feet of said Lot 1 in Delaware Village,
being a resubdivision of Lots 5 to 9 inclusive,* in
Block 3 in Kelly and O'Briens South Evanston Sub-
division of the South half of the North half of the
North East quarter of the North East quarter of
Section 25, Township 41 North, Range 13, East of
the Third Principal Meridian, except that part of
said Lots lying East of a line 40 feet west of and
parallel with the East line of said Section 25 in
the City of Evanston, Cook County, Illinois. ALSO,
easements appurtenant to the above described real
estate set forth in the Declaration of Easements
and Covenants rec m.-dicd 1_-ti the Rec ordC--c' s Ofi` ce of
Cook Count.=, 1 i linols as Document -No. 18 42115 and
subject to the easements arzd agreements reserved
for the benefit of adjoining parcels in said Declara-
tion, which is incorporated herein by reference there-
to for the benefit of the real estate above described
and adjoining parcels,

and is subject to compliance with all other provisions of the
Zoning Ordinance, other applicable laws and the following
conditions:
1) that the ownership of said property, consisting of
two adjoining lots shown in a plat recorded with
the office of County Recorder, having been held in
common ownership subsequent to June 22, 1964, shall
not be split nor used in such a way as to conflict
with the control over use provisions of the
Evanston Zoning Ordinance; and
2) that there shall be no bushes, shrubbery nor other
natural obstructions allowed within 20 feet of the
lot corner formed by the intersection of two streets
on said property.
SECTION 4: This ordinance shall be in full force
and effect from and after its passage
and approval in the manner provided by law.
