AN ORDINANCE
Granting Utility Easement Permits to
Northwestern University
WHEREAS, Northwestern University must provide heat for
the new Physical Recreation Building to be constructed at
617 Foster Street; and
WHEREAS, the Physical Recreation Building was originally
designed to use natural gas as a heating fuel but the appli-
cation of Northwestern University for natural gas was refused
by the utility company as a result of the shortage of said
fuel; and
• WHEREAS, Northwestern University has researched the poss-
ibility of using other fuels and eliminated them either because
of shortages, or because of their adverse ecological impact on
the community; and
WHEREAS, Northwestern University has requested that it be
granted permission to install, construct, operate and maintain,
and in the future, repair and replace, a high pressure steam
supply and return lines system, togetherwiththe necessary
appurtenances underneath the surface of the sidewalks in the
following areas:
1. Under the City sidewalk; west side of Sheridan Road
from a point 139 feet north of the north line of
Emerson Street, to a point 5 feet north of the north
line of Foster Street.

2. Under the City sidewalk; north side of Foster Street
from a point under the sidewalk on the west side of
Sheridan Road to a point approximately 185 feet west
of the west line of Sheridan Road; and
WHEREAS, this proposed work could be carried on concurrently
with the work on the chilled water lines authorized by Ordinance
14-0-73, adopted by the City Council on March 5, 1973, so as to
minimize the inconveniences to the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That permission is granted to Northwestern
University pursuant to Section 42-111 of
the Code of the City of Evanston:
(a) to install, construct, operate and maintain, and
in the future repair or replace as maintenance
requires a high pressure steam supply system and
return lines;
(b) that a permit shall grant to Northwestern University
the right to construct a.high pressure steam system
consisting of supply and return lines, together with
the necessary appurtenances, beneath the sidewalks on
the (1) west side of Sheridan Road from a point 139
feet north of the north line of Emerson Street, to a
point 5 feet north of the north line of Foster Street;
and (2) north side of Foster Street from a point under
the sidewalk on the west side of Sheridan Road to a
point approximately 185 feet west of the west line of
Sheridan Road.

SECTION 2: That the City Manager is hereby directed
to grant permits for the aforementioned
installations subject to compliance with all other sections and
provisions of the Code of the City of Evanston and further sub-
ject to the following conditions:
(a) that Northwestern University shall be required to
repair or replace to.preconstruction condition or
better any sidewalk, pavement, street or other
public improvement or property damages or disturbed
by reason of the construction, maintenance, repair
or alteration of the aforesaid high pressure steam
supply system, and further that Northwestern Univer-
sity shall be required to avoid interference with
all municipal utilities;
(b) that Northwestern University shall indemnify and
hold harmless the City of .Evanston from any and all
losses, damage or claims for damages arising out
of the exercise of the permits granted for construc-
tion under the of t1tc �City.
SECTION 3: This ordinance shall be in full force and
effect from and after its passage, approval
in the manner provided by law.
