Katz, and D. & H Building Corporation, for a Variation • from the Off -Street Parking Provisions of the Evanston Zoning Ordinance, Adopted November 21, 1960 June 4, 1973 Oct. 29, 1973 1n3 WHEREAS, the Zoning Board of Appeals held a public hearing on March 202 1973 upon the application of Harris Trust and Savings Bank, as 'trustee under Trust #33644, and the beneficiares thereof, Ernest R. Katz, Ben Olevsky, Maurice L. Rivkin, Isador Katz, Burton L. Katz, and D & H Building Corporation, for a variation from the off-street parking provisions of the Zoning Ordinance to allow the continued use of a building containing 120.dwelling units with fewer than 84 off-street parking spaces, as required for the property located at 800-804 Hinman Avenue, within an R7 General Residence District; and WHEREAS, the Zoning Board of Appeals has recommended the denial of said application; and WHEREAS, the City Council has reviewed the evidence adduced at said hearing.and the report of the Zoning Board of Appeals and is of .the opinion that said application should be granted; and WHEREAS, the City Council has determined that the granting of said application will not alter the essential character of the neighborhood in which the property is located. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the application of Harris Trust and Savings Bank, as Trustee under Trust #33644 and the'bene- ficiaries thereof, Ernest R. Katz, Ben Olevsky, Maurice L. Rivkin, Isador Katz, Burton L. Katz and D & H Building Corporation, for a 50-0-73 variation from the off-street parking requirements of the Evanston Zoning Ordinance, adopted November 21, 1960, insofar as said provision pertains to the property located'at 800-804 Hinman, Evanston, Illinois,. and legally described as - Lots 13 and 14 in Block 11 in White's Addition to Evanston in Section 19, Township 41 North, Range 14, East of the Third Principal Meridian, according to a resubdivision of the East half of Block ,ll and the West half of Block 10 in said Addition,'recorded November 13, 1873 on Book 6 of Plats, page 64, as Document 135593, in Cook County, Illinois, is hereby granted so as to permit the continued use of the aforesaid. premises containing 120 dwelling units with'no less than 44 off-street I parking spaces within an R7 General Residence district subject to compliance with all other provisionsof the Zoning Ordinance and other applicable laws'and the following conditions: a) the property owners shall lease additional off-street parking spaces from City or private sources to a total of 84 spaces if such spaces became available within 1500 feet of the property. b) all parking spaces currently within the building shall be leased along with the apartments therein. c) a covenant, in recordable form, be executed by the property owner accepting the aforesaid condition. SECTION 2. The Director of Inspections and Permits is hereby ordered and directed to grant such permits as shall be required to effectuate provisions of this ordinance. SECTION 3.
