HomeMy WebLinkAboutORDINANCES-1973-062-O-7362-0-73 010 AN ORDINANCE Amending Section 4-511 of Chapter 4, of the Code of the City of Evanston, 1957, as amended, Relating to Alcoholic Liquor Dealers. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS : SECTION 1: That the first paragraph of Section 4-511 of the Code of the City of Evanston is hereby amended to read as follows: (1) QPNo licensee or officer, associate, member, representative, agent or employee of such licensee shall sell, give or deliver alcoholic liquor to any person under the age of twenty- one (21) years, except as provided in Sub -section (2), or to any intoxicated person, or to any person known by him to be an habitual drunkard, spendthrift, insane, mentally ill, mentally deficient or in need of mental treatment. No person after purchasing or otherwise obtaining alcoholic liquor shall sell, give or deliver such alcoholic liquor to another person under twenty-one (21) years except in the performance of a religious cermony or service, and except as provided in Sub -section (2). (2) Sub -section (1) of this Section does not apply to the sale, gift or delivery of beer and wine' to persons under the age of 21 years but at least 19 years of age. (3) It shall be unlawful for any person under the age of twenty-one (21) years to misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor in any place in ® - 2 - the City where alcoholic liquor is sold 01 1 except that pursuant to Sub -section (2) it shall be unlawful for any person under the age of nineteen (19) years to mis- represent his or her age for the purpose of purchasing or obtaining beer or wine in any place in the City where beer or wine is sold. (4) In every place in the City where alcoholic liquor is sold there shall be displayed at all times in a prominent-plaee-a printdd card which shall be supplied by the City Clerk and which shall read substantially, as follows: 'Warning: You are subject to a fine up to $500.00 under the ordinances of the City of Evanston, if you purchase alcoholic liquor, or mis- represent your age for the purpose of •, purchasing or obtaining alcoholic liquor.' (5) It shall be unlawful for any'holder of -a liquor license, or his agent or employee, to suffer or permit any minor to be or remain in any room or compartment adjoining or adjacent to or situated in the room or place where such licensed premises is located; provided that this paragraph shall not apply to any minor who is accompained by his or her parent or guardian, or to any licensed permises which derives its principal business from the sale of service or other commodities than alcoholic liquor. (6) In addition to all other fines and penalties, the local liquor control commissioner may revoke the liquor dealer's license for any violation of the above paragraph. (7) It shall be unlawful for any parent or guardian to permit any minor child of which he or she be parent or guardian to violate any provisions of this secti. on:' U • SECTION 2: All ordinances or portions of ordinances in conflict with the terms of this are hereby repealed. SECTION 3: This ordinance shall be in full force and effect on and after October 1, 1973 after its passage and approval in the manner provided by law.
