HomeMy WebLinkAboutORDINANCES-1974-028-O-74-�G Introduced: 3/18/74 Adopted as Amended: 7/15/74 28-0- 74 AN ORDINANCE Granting the Application of Amelia Woltman for a Special Use Permit to Permit the Retention of a Fence on the Property Located at 1146 Wesley Avenue. WHEREAS, on December 18, 1973, the Zoning Board of Appeals • conducted a public hearing upon the application of Amelia Woltman for a Special Use Permit to permit the retention of a fence located in a required front yard on the property located at 1146 Wesley Avenue, Evanston, an R-3 two-family residence district, said public hearing having been conducted that date and continued to January 15, 1974, pursuant to notice and publication thereof as provided by law, and WHEREAS the Zoning Board of Appeals has failed to reach a consensus as to the findings upon this application, and WHEREAS the failure of the application to receive four concurring votes to approve is deemed to be a denial of said application, and WHEREAS the City Council of the City of Evanston makes the following findings relating to the application of Amelia Woltman: 28-0-74 p �' -2- a) the existing fence located in a required front yard is so designed and located that the public health, safety and welfare will be preserved, b) the existing fence will not cause appreciable injury to the value of other property in the neighborhood, c) the granting of the proposed Special Use will not subvert or defeat the primary purposes of the Zoning Ordinance or of a zoning district in which the property is located when • its effect is considered in conjunction with the cumulative effect of the number of various Special Uses of all types presentl-7 located in the adjacent area and the City as a whole, d) a fence in the required front yard is listed as a Special Use in the R-3 two-family residence district pursuant to Section IV J.S. of the Zoning Ordinance, and, WHEREAS the City Council of the City of Evanston finds that such relief should be granted, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF`THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: • SECTION 1: That the application of Amelia Woltman for a Special Use permit to allow the retention of a fence located in the required front yard on the property located at 1146 Wesley Avenue, Evanston, Illinois, and legally described as: i L� • 28-0- 74 -3 Lot 3 in Block 2 in Nate and Adam's addition to Evanston in Section 24, Township 41 North, Range 13, East of the 3rd Principal Meridian in Cook County, Illinois, is hereby granted, subject to compliance with all other provisions of the Zoning Ordinance and other applicable laws, except for relief from the Housing Code that could be obtained regarding the' basement unit, all in accordance with the findings of the City Council herein. SECTION 2: The Director of Inspections and Permits is hereby ordered and directed to grant such permits as shall be required to effectuate provisions of this Ordinance. SECTION 3: This Ordinance shall be in full force and effect from and after its passage and Approval in the manner provided by law. Introduced March 18 Adopted July 15 Attest: Approved Ma+iri ca F .
