AN ORDINANCE
Amending the Evanston Zoning I
Ordinance to Grant Final
Authority to the Zoning Board
of Appeals to Hear and Decide
Applications for Special Use
Permits to Permit the Erection
or Retention of Fences in Re-
quired Front Yards {

WHEREAS, the Zoning Amendment Committee conducted a
public hearing on January 3, 1974 to deliberate the question of
making the decision of the Zoning Board of Appeals on application:
for Special Use Permits to permit the installation of fences in
required front yards, a final determination of such matters, pur-
suant to notice and publication thereof in the manner provided

by law; and
WHEREAS, the Zoning Amendment Committee has made its
findings and recommendations to the City Council of the City of
Evanston,
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Evanston, Cook County, Illinois: 1

SECTION 1: That Section XII C 2 of the Evanston Zoning'
Ordinance adopted November 21, 1960, as 1
amended, be further amended by adding thereto:

"g. to hear and decide all applications for special '
use permits relating to the erection or retention
of fences in required front yards as provided by
Section. IV J. 5 of this Ordinance."'
• SECTION 2: That Section XII C 5a of the Evanston ZoninG
�. Ordinance adopted November 21, 1960, as
amended, be further amended to read as follows:
"Action by the Board on appeals from rulings of

enforcing officers, appeals for a time extension, appli-
cation for special use permits to permit the erection or
retention of a fence in a required front yard, and appli-
cations for variations from the provisions of this
Ordinance, other than type one variations, shall con-
stitute the final action by the municipal authorities."
SECTION 3: That Section XII C 5b of the Evanston Zoning
Ordinance adopted November 21, 1960,,as
amended, be further amended to read as follows:
"The findings of the Board on appeals from rulings
of enforcing officers, appeals for time extentions,
application for special use permits to permit the
erection or retention of a fence in a required'
front yard, and applications for variations, other
than type one variations, shall be in writing and
shall be arrived at in each specific case after a
public hearing. A report of said findings, with
the terms of the relief granted specifically set
forth in a conclusion or separate statement, shall
be transmitted to the appellant or applicant, with
copies to the City Council, within a reasonable
time, '

SECTION 4: All ordinances or parts of ordinances in con-
flict herewith are expressly repealed.
SECTION 5: This ordinance shall be in full force and i
effect from and after its passage, approval

and publication in pamphlet form in the manner provided by law.
