AN ORDINANCE
Amending the Evanston Zoning
Ordinance to Empower the
City Manager to Grant Temporary
Exemptions Therefrom During
Construct..ion.
WHEREAS, the Zoning Amendment Committee conducted a
public hearing on January 3, 1974, to consider amending the
Evanston Zoning. Ordinance by removing the necessity of granting
a. variation for non-conformance caused by construction for a
temporary period by placing authority to grant exemption for
such non-compliance in the hands of the City Manager, and the
notice of said hearing was published in the manner required.
by law; and
WHEREAS, the Zoning Amendment_ Committee has submitted
its report recommending said amendment accompanied'by findings
of fact and specifying the reasons for the recommendations:
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Evanston, Cook County, Illinois:
SECTION 1: That Section IV of the Evanston Zoning
Ordinance, as amended, be further amended by the creation of
. a new Section IV.O., which reads as follows:
"0. Temporary Exceptions During Construction
Upon written application therefor stating the nature of
prospective non-compliance and its expected duration, the
City Manager, by and with the consent of the Planning &
Developmert Committee of the City Council, may -grant to the
owner of property within the City a temporary exemption from
the provisions of this ordinance, subject to such conditions
as may be determined to be reasonable, when such exemption,
based upon facts submitted by the applicant, is necessary to
permit the construction, alteration, or demolition of improve-
ments upon the property. Each temporary exemption so granted.

shall be in writing and a copy thereof_ together with the

application and supporting documentation, if any, shall be
transmitted to the Director of Inspections and Permits to be
i
maintained among the records of that Department."
SECTION 2: That all ordinances or parts of ordinances,
i
in conflict with the provisions of this ordinance are hereby
I
repealed,
SECTION 3: That this ordinance shall be in full '
i
force and effect from and after its passage, approval and
publication in the manner provided by law.
