AN ORDINANCE

Amending the Municipal Code of 1
the City of Evanston Regulating
Tag Days
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,
COOK COUNTY, ILLINOIS:
SECTION 1: That Section 42-142 of the Municipal Code of the
City of Evanston as amended is hereby further
amended to read as follows:
"Section 42-142. Any organization desiring a permit'to
conduct, a Tag Day shall make application through a duly
authorized representative to the City Manager at least
• sixty (60) days prior to the Tag Day date for which
permission is requested, but no earlier than November
1 in the immediate preceding year. The application
herein required shall contain the following information
or, in lieu thereof, a statement satisfactory to the
City Manager of the reason or reasons why such infor-
mation or any item thereof is not furnished:
(a) A financial statement for the last preceding fiscal
year showing the amount of money raised by the
applicant organization for charitable purposes,
together with the cost of raising said money, and
the final distribution thereof.
(b) A full statement of the general character and extent
of the charitable work being done or to be done by
the applicant organization, showing how much thereof
is',being done or is to be done within the City of
• Evanston.
(c) A statement that the actual cost of the Tag Day will
not exceed twenty-five (25) per cent of the total
amount to be raised or, if the cost of solicitation
is expected to exceed twenty-five (25) per cent, a
statement of what the maximum cost is expected to
be, together with a statement of any special facts
tending to show why a cost higher than twenty-five

(25) per cent is considered reasonable in the particular
case.
(d) A statement to the effect that if a permit is granted,
it will not be used or represented in any way as an
endorsement of the Tag Day by the City of Evanston or
any officer or department thereof.
(e) A statement that the applicant organization is tax exempt
under the Internal Revenue Code of the United States,
and that contributions to said organization are allowable
deductions for the donor under the Internal Revenue Code.
(f). A statement to the effect that if the permit is granted,
no person under the age.of 14 will be permitted to solicit
or collect money, except where the solicitation is for
the benefit of a children's organization.
• (g) A statement that the applicant organization is in com-
pliance with those provisions of the Illinois Revised
Statutes now constituted, and as hereinafter may be
amended, which pertain to charitable solicitations (Chap-
ter 23, Section 5101-5114).
(h) A hold harmless release form be completed in full.
(i) Such other information as may be reasonably required by
the City Manager in order for him to determine the kind
and character and method of the proposed Tag Day solici-
tation, when it will take place and for what period of
time, and whether such solicitation is in the interest of.
and not inimical to, the safety, convenience or welfare
of the inhabitants of the City."
If, while any application is pending, or during the term of
any permit granted, there is any change in fact, policy or
method that would alter the information given in the appli-
cation, the applicant organization shall notify the City
Manager in writing thereof within 24 hours after such change
• occurs or becomes known to the applicant organization."
SECTION 2: That Section 42-145 of the Municipal Code of the
City of Evanston as amended is hereby further
amended to read as follows:

"Section 42-145. The City Manager shall limit the number
of Tag Days during the period September 1 to November 30
of each calendar year to two in number. Such permits
for the aforesaid period shall be issued only to local
affiliates of national organizations which organizations are
conducting national campaigns upon the day requested.
No more than one organization shall receive a permit to
conduct a Tag Day on.any one day;and further,no organiza-
tion shall be permitted to conduct more than one Tag Day
within the City during any calendar year.
Except as provided herein there shall be no limit on the.
total number of tag days permitted within the City of
Evanston. "
SECTION 3: All ordinances or- parts of ordinances in conflict:
herewith are hereby repealed.
SECTION 4: This ordinance shall be in full force and effect
from and after its passage and approval in the
manner provided by law.
