HomeMy WebLinkAboutORDINANCES-1974-029-O-74• r 29-0-74 AN ORDINANCE Vacating Portions of Livingston and Chancellor Streets o BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That those portions of property dedicated as public streets Livingston and Chancellor commencing approximately 230.7 feet west of the west property line of Asbury Avenue in a 66 foot right-of-way extending approximately 265 feet and 132 feet on said Livingston and Chancellor Streets, respectively, and legally described as: Parcel 1: The north sixty-six (66) feet of the south eight hundred thirty-seven and five -tenths (837.5) feet, and the north sixty-six (66) feet of the south four hundred forty one and five -tenths (441.5) feet of the east half of the west half of lot nineteen (19) in George Smith's subdivision of the southern part of the Ouilmette Reserve, in Township forty - .two (42) North, Range thirteen (13), East of the Third Principal Meridian; and The North sixty-six (66) feet of the South eight hundred thirty-seven and five -tenths (837.5) feet of the West half (W2) of the West half (W2) of Lot Nineteen (19) in George Smith's subdivision of the South part of Ouilmette Reserve in Township forty- two (42) North, Range thirteen (13), East of the Third Principal Meridian, be and the same is hereby vacated and closed, inasmuch as the cor- porate authorities of the City of Evanston have determined that the public interest will be subserved by vacating those portions of the public streets hereinabove described. SECTION 2: That the adjoining property owners who re- ceive benefits of this vacation shall pay to the City of Evanston the sum of Twenty thousand, three hundred forty-three and 00/100 ($20,343.00) dollars in consideration for ..... ...............,...-._.. per» 11 + : M • 29-0-74 IWM the said action by.the City Council of the City of Evanston, and shall execute a covenant running with the land which shall restrict, the use of the vacated streets for surface parking purposes only. SECTION 3: The City of Evanston hereby reserves to itself and to all public utilities owning public service facilities such rights -of -way, license and easement rights to such equipment as are presently installed and located on those portions of the public right-of-way hereby closed together with the right of ingress and egress for the maintenance, renewal and reconstruction thereof. SECTION 4: All ordinances or parts of ordinances in con- flict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval and payment of the consideration stated herein, all in accordance with the manner provided by law.
