HomeMy WebLinkAboutORDINANCES-1974-040-O-74.f P 8 • Introduced: 4/1/74 Adopted: 4-8-74 as amended 40-0-74 AN ORDINANCE Amending the Evanston Zoning Ordinance as it Regulates Restaurants WHEREAS the Zoning Amendment Committee held a public hear- ing on November 1, 1973 to consider the revision of the Evanston Zoning Ordinance as it pertains to restaurants in the various zoning districts of the City pursuant to notice and publication thereof, in accordance with law; and WHEREAS the Zoning Amendment Committee has made certain • findings and recommendations regarding the regulation of restau- rants within the zoning districts; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Evanston, Cook County, Illinois: SECTION 1: That Section III of the Evanston Zoning Or- dinance adopted November 21, 1960, as amended be further amended as follows: a) by adding thereto after the definition of the words Research Laboratory and before the words Retirement Home (Home for the Aged) the follow- ing definition: "Restaurant. A public eating place where essen- tially all food is served and consumed at a table or counter within a completely enclosed building." b) by amending the definition of Drive -In Restaurant • to read as follows: "Drive -In Restaurant. Any business where food (including frozen desserts) and beverages are sold, where an automobile parking area is pro- vided, and where such food or beverages are consumed in automobiles parked in the parking area." i. • 40-0-74 -2- _1 8 3 SECTION 2: That Section VIII, B.l.r. of the Evanston Zoning Ordinance adopted November 21, 1960) as amended be hereby specifically repealed. SECTION 3: That Section VIII B.2. of the Evanston Zoning Ordinance adopted November 21, 1960, as amended be further amended to read as follows: "2. Additional Permitted Uses - B2, B3, B4, B5 Districts; a. Department Stores b. Restaurants C. Theatres, but not including outdoor theatres. d. Undertaking establishments and funeral parlors, but only in B4 Business Districts." • SECTION 4: That Section VIII B4 of the Evanston Zoning Ordinance, adopted November 21, 1960 as amended, be further amended by adding thereto subsections "o" and "p" to read as follows: "o. Restaurants in B1 Business Districts only. �4 "p. Eating establishments other than 'restaurants'', bt< i 'drive-in restaurants' as defined herein."�� SECTION 5: That Section IX C3 of the Evanston Zoning Ordinance adopted November 21, 1960, as amended be further amended to read as follows: ., "3. SPECIAL USES. a. Any other manufacturing, fabricating, assembling, • disassembling, repairing, storing, cleaning, servicing, or testing establishment, except those prohibited in Subsection A of this Section IX. b. Airports. C. Drive -In restaurants. d. Junk yards. e. Radio and Television Towers." i L .t 9 0 40-0-74 -3- SECTION 6: That Section VIII B.1, of the Evanston Zoning Ordinance adopted November 21, 1960, as amended be further amended to read as follows: "d. Drug stores and pharmacies. Dry cleaning and laundry collection stations and dry cleaning and laundry establishments, provided that any dry cleaning operations use only non -inflammable solvents in the cleaning process. Dry goods stores. Dwelling units, but located only in a principal building provided however that dwelling units, other than those in a hotel or janitor's quarters, are not permitted below the second floor in any Business Dis- trict. Where there are two or more principal build- ings on a lot other than a corner lot, dwellings are permitted only in the one which is closer to the street." ! SECTION 7: That Section VIII A.I. of the Evanston Zoning 1 Ordinance adopted November 21, 1960, as amend.- ed be further amended to read as follows: "l. All business, service, storage, merchandise, display and repair processing, where allowed, shall be con- D eructed only within a completely enclosed building, except for off-street automobile parking, off-street loading, open sales lots, automobile service stations, vending machines and eating establishments in dis- tricts where such uses are allowed." SECTION S: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 9: This ordinance shall be in full force and ef- fect from and after its passage and approval and publication in pamphlet form in accordance with law. Introduced .
